Certain offices of the Borough shall be filled
by appointment unless otherwise specified; such appointments shall
be made by the Mayor, with the advice of and consent of the Council,
including vacancies, which shall be for the unexpired term only. The
method of appointment shall be as provided in N.J.S.A. 40A:60-5. The
term for each office shall be as provided by statute and Borough ordinances.
A. Appointment and term. (N.J.S.A. 40A:9-133 et seq.)
A Municipal Clerk shall be appointed by the Mayor, with the advice
and consent of the Council. The term of office of Municipal Clerk
shall be for three years from the first day of January in the year
in which he or she was appointed.

B. General duties. The Clerk shall attend all meetings
of the Council, keep a correct record of all its proceedings, have
the power and authority to take and administer oaths and affirmations
in Borough matters, and perform all the functions of municipal clerks
as specified by law. In addition, he shall perform such other duties
as the Council may require. (N.J.S.A. 40A:60-1 et seq.)
C. Records. In addition to recording ordinances and resolutions
of a permanent character, the Clerk shall have custody of and shall
safely keep all records, books and documents of the Borough, except
those committed by ordinance to any other office or transferred thereto
by the Mayor and Council. He shall, upon request and upon the payment
of the fees prescribed therefor by resolution of the Council for the
use of the Borough, furnish a certified copy of such paper in his
custody, under the corporate Seal of the Borough. (N.J.S.A. 47:1A-5)
D. Filing of rules, regulations. All rules or general
regulations made by any department, officer, agency or authority of
the municipality shall be filed with the Clerk. The Clerk shall maintain
a current compilation of all such rules and regulations, which shall
be available for public inspection in his office during business hours.
E. Seal. The Clerk shall cause the Corporate Seal of
the Borough to be affixed to instruments and writings when authorized
by ordinance or resolution of the Council or when necessary to exemplify
any document on record in his office or to certify any act or paper
which, from the records in his office, shall appear to have been a
public act of the Borough or a public document. He shall not affix
said seal or cause it to be affixed to any other instrument or writing
or other paper, unless required by state statute or ordinance of the
Borough of Park Ridge. (N.J.S.A. 40A:60-1; 2A:82-14)
F. Duties regarding sureties, bonds, leases; reports
required. The Clerk, subject to the supervision of the Mayor and Council,
shall:
(1) Be the depository and custodian of all official surety
bonds furnished by or on account of any officer or employee, all insurance
policies upon or with respect to risks insured for the benefit of
the Borough or to protect it against any claim, demand or liability
whatsoever, and all formal contracts for work, labor services, supplies,
equipment and materials to which the municipality may be a party.

(2) Be the depository for and have custody of all performance
bonds running to the Borough as obligee, or any other form of security
given by any contractor, subdivision developer or other persons on
account of work done or to be done in or for the Borough.
(3) Have custody of all leases of property owned by the
Borough.
(4) Report to the Council, at such time as may be required,
on the coverage, premium and expiration date of each surety bond and
insurance contract and the terms of leases and their expiration dates.
(5) The
Municipal Clerk shall be reviewed annually by the Personnel Committee.
Its performance evaluation report shall be presented to the Mayor
and Council and privately to the Municipal Clerk by the Council President.

G. Additional duties. The Clerk shall also:
(1) Administer the provisions of the Borough ordinances
with reference to the licensing of occupations and activities for
which licenses are required by law or ordinance to be obtained from
the Clerk.
(2) Keep a calendar of all matters pending before the
Council.
(3) Issue certificates regarding the approval of land
subdivisions which have been duly approved by the Planning Board,
pursuant to N.J.S.A. 40:55-1.24.
(4) The Borough Clerk is authorized to approve the granting
of raffle and bingo licenses as is provided by law. For purposes of
this subsection, the Municipal Clerk is now the issuing authority
for bingo and raffle licenses in the Borough of Park Ridge.

A. Appointment and term. (N.J.S.A. 40A:9-141 et seq.)
(1) A Tax Collector shall be appointed by the Mayor, with
the advice and consent of the Council. The term of office of the Tax
Collector shall be for four years from the first day of January in
the year in which he or she was appointed.
B. Powers and duties. (N.J.S.A. 40A:9-141 et seq.) The
Tax Collector shall:
(1) Collect and hold all moneys assessed or raised by
taxes upon real and personal property within the Borough.
(2) Maintain such records as required by law, including
but not limited to:
(a)
Sums received each day for taxes and names of
persons on whose account the taxes are received.
(b)
A record and account of the tax collections
of the Borough.
(3) Within 60 days of the end of the fiscal year or when
so required by Council, submit a full report and true statement of
Borough finances from the beginning of the official year, as well
as a list of the delinquent taxpayers for the previous year. Two copies
of such report and list shall, at the required time, be filed with
the Clerk. Deposits of Borough funds and additional reports to the
governing body shall be made as required by law.
(4) Disburse moneys as authorized by a warrant ordered
by the Council, signed, numbered and attested as provided by law.

(5) The
Tax Collector shall be reviewed annually by the Personnel Committee.
Its performance evaluation report shall be presented to the Mayor
and Council and privately to the Tax Collector by the Council President.

C. Compensation. (N.J.S.A. 40A:9-141) The compensation of the Tax Collector shall be as provided pursuant to §
2-39 of the Code of the Borough of Park Ridge.

A. Appointment and term. (N.J.S.A. 40A:9-146 et seq.)
A Tax Assessor shall be appointed by the Mayor with the advice and
consent of the Council. The term of office of the Tax Assessor shall
be for four years from the first day of July in the year in which
he or she was appointed.
B. Powers and duties. (N.J.S.A. 40A:9-141 et seq.) The
Tax Assessor shall possess and perform such powers and duties as granted
or required by law and as the Council may, or ordinance or resolution,
require.
C. Compensation. (N.J.S.A. 40A:9-149) The compensation of the Tax Assessor shall be provided pursuant to §
2-39 of the Code of the Borough of Park Ridge.
A. The position of Deputy Borough Clerk is created pursuant
to N.J.S.A. 40A:9-135.
B. The Deputy Clerk shall perform all of the duties of
an assistant Borough clerk and, in addition thereto, shall have all
powers and perform all the duties of the Borough Clerk during such
times and for such specific periods as the Borough Clerk shall be
absent.
C. The Deputy Clerk shall be appointed by resolution
of the Mayor and Council and shall be appointed for the term of one
year, commencing January 1 of the year in which he is appointed.
D. The provisions of Subsection
C above shall not apply where the Deputy Clerk shall have been certified as a permanent employee by the New Jersey Division of Civil Service. In that event and upon said certification, said Deputy Clerk may be removed only for cause as set forth in civil service procedure.

A. Appointment and term. A Municipal Treasurer shall be appointed by the Mayor
with the advice and consent of the Council, and shall hold office
for a term of one year, or until his or her successor has been appointed
and qualified, subject to the tenure provisions of the applicable
laws of the State of New Jersey. The Municipal Treasurer shall also
act as the Municipal Finance Officer, provided that the statutory
requirements are met.
B. Duties. The Municipal Treasurer shall have the custody
of the general funds of the Borough and the Department of Public Works
and Public Utilities, including the Division of Electric Utilities
and the Division of Water Utilities. The Municipal Treasurer shall
also perform such lawful duties as may be assigned by the Mayor and
Council or the Borough Administrator and shall otherwise have such
power and duties as may be prescribed from time to time by the ordinances
of the Borough, and the laws of the State of New Jersey. The Municipal
Treasurer shall report to the Borough Administrator.

C. The Municipal
Treasurer shall be reviewed annually by the Personnel Committee. Its
performance evaluation report shall be presented to the Mayor and
Council and privately to the Municipal Treasurer by the Council President.

A. Qualifications. To be eligible for appointment, the
appointee shall hold a degree in civil engineering from a recognized
college of engineering and be licensed in the State of New Jersey.
B. Duties. The Municipal Engineer shall perform the duties
as required by law and the ordinances of the Borough of Park Ridge.
C. Appointment. The Municipal Engineer shall be appointed
by the Mayor, with the advice and consent of the Council.
D. Term. The term of office of the Municipal Engineer
shall be for one year unless otherwise provided by law.

A. Appointment and term. The Public Utilities Superintendent/Road
Superintendent shall be appointed by the Mayor with the advice and
consent of the Council and shall hold office at the pleasure of the
governing body and until his or her successor has been appointed and
qualified, subject to the tenure provisions of the applicable laws
of the State of New Jersey. In connection with the foregoing, the
Mayor and Council shall entertain any recommendations from the Advisory
Council - Board of Public Works in the Department of Public Works
and Public Utilities.
B. Duties.
(1) The Public Utilities Superintendent/Road Superintendent
shall:
(a)
Have the primary responsibility and authority
for the supervision of the care and maintenance of public streets,
roads, avenues, buildings, grounds, places and facilities, sewers,
motor vehicles and other equipment of the Borough, excepting therefrom
the maintenance of Borough Hall, library and pistol range.
(b)
Have the primary responsibility and authority
for supervision of the construction, operation and maintenance of
the electric and water systems of the Borough.
(c)
Recommend extensions to and improvements in
the electric and water systems.
(d)
Exercise supervision over the following supervisors
and divisions:

Supervisor of the Division of Roads, Parks,
Public Buildings and Recycling.
[2]
Supervisor of the Division of Electric Utilities.
[3]
Supervisor of the Division of Water Utilities,
Sewers and Vehicle Maintenance.
(e)
Perform such additional lawful duties as may
from time to time be assigned by the Board of Public Works or the
Mayor and Council.
(2) The Public Utilities Superintendent/Road Superintendent
shall report to the Advisory Council, Board of Public Works.
(3) The
Public Utilities Superintendent/Road Superintendent shall be reviewed
annually and a performance evaluation report will be presented by
the Advisory Council, Board of Public Works in the Department of Public
Works and Public Utilities.

by the New Jersey Department of Civil Service, and the appointee shall
hold office at the pleasure of the Mayor and Council and until his
or her successor has been appointed and qualified subject to the tenure
provisions of the applicable laws of the State of New Jersey.
B. Duties.
(1) The General Supervisor, Roads, shall have supervision
of and responsibility for:
(a)
The Division of Roads, Parks, Public Buildings
and Recycling.
(b)
Public parks, grounds and buildings.
(c)
Public roads, streets, avenues and sidewalks.
(d)
The Borough's mandatory recycling program.
(e)
Equipment related to the performance of duties
set forth herein.
(2) The General Supervisor, Roads, shall:
(a)
Cause to be repaired and maintained the Borough
property, facilities, programs and related equipment for which he
has assigned responsibility.
(b)
Discharge and perform such other lawful duties
as may be assigned from time to time.
(c)
Report to the Public Utilities Superintendent/Road
Superintendent.

has been appointed and qualified, subject to the tenure provisions
of the applicable laws of the State of New Jersey.
B. Duties.
(1) The General Supervisor, Electric Distribution, shall
have supervision over and responsibility for:
(a)
The Division of Electric Utilities.
(b)
The construction, operation and maintenance
of the electric system of the Borough and the extension and improvement
thereof at the direction of the Public Utilities Superintendent/Road
Superintendent.
(c)
The performance of such additional lawful duties
as may from time to time be assigned by the Public Utilities Superintendent/Road
Superintendent.
(2) The General Supervisor, Electric Distribution, shall
report to the Public Utilities Superintendent/Road Superintendent.
In the absence of the General Supervisor, Water, the General Supervisor,
Electric Distribution, shall be in charge.

of General Supervisor, Electric Distribution, is hereby created. The
position shall be filled by appointment of the Mayor with the advice
and consent of the Council, subject to certification by the New Jersey
Department of Civil Service, and the appointee shall hold office at
the pleasure of the Mayor and Council and until his or her successor
has been appointed and qualified, subject to the tenure provisions
of the applicable laws of the State of New Jersey.
B. Duties.
(1) The General Supervisor, Water, shall have supervision
over and responsibility for:
(a)
The Division of Water Utilities, Sewers and
Vehicle Maintenance.
(b)
The construction, operation and maintenance
of the water and sewer systems of the Borough and the extensions and
improvement thereof at the direction of the Public Utilities Superintendent/Road
Superintendent.
(c)
The performance of such additional lawful duties
as may from time to time be assigned by the Public Utilities Superintendent/Road
Superintendent.
(2) The General Supervisor, Water, shall report to the
Public Utilities Superintendent/Road Superintendent. In the absence
of the Public Utilities Superintendent/Road Superintendent, the General
Supervisor, Water, shall report to the General Supervisor, Electric
Distribution.

Designation to the office of Zoning Officer and designation of an alternate Zoning Officer to perform the duties of the Zoning Officer in the absence of the Zoning Officer shall be made by the Mayor with the advice and consent of the Borough Council of the Borough of Park Ridge. The term of office shall be for one year, commencing on January 1 of the year in which appointed. Any vacancy in the office shall be filled by the Borough Council for the unexpired term only. The duties of the Zoning Officer are set forth in Chapter
101, Zoning, of the Code of the Borough of Park Ridge.
Appointive officials relative to the health regulations of the Borough are as set forth In Chapter
17, Health, Board of, of the Code of the Borough of Park Ridge. Such provisions cover the appointment and the terms of office of a Sanitary Inspector and a Registrar of Vital Statistics and the designation by the Board of Health of a President and a Secretary.
The Borough Attorney shall be appointed by the
Mayor and Council for the term of one year from the first day of January
of the year of his appointment and until his successor has been appointed
and qualified. He shall be an attorney at law of New Jersey but need
not be a resident of the Borough.
A. The Attorney shall have such powers and perform such
duties as are provided for his office by general law or the ordinances
of the Borough of Park Ridge. He shall represent the Borough in all
judicial and administrative proceedings in which the municipality
may be a party or have an interest, and shall, at the direction of
the governing body, represent its elected and appointed officers,
departments and agencies in judicial and administrative proceedings
in which they shall be a party or have an interest. He shall give
all legal counsel and advice where required by the Council or any
member thereof and shall, in general, serve as the legal advisor to
the Council on all matters of Borough business. In furtherance of
such general powers and duties but without limitation thereto, the
Borough Attorney shall:
(1) Draft or approve as to form and sufficiency all legal
documents, contracts, deeds, ordinances and resolutions made, executed
or adopted by or on behalf of the municipality.
(2) With the approval of the Council, conduct appeals
from orders, decisions or judgments affecting any interest of the
Borough as he may in his discretion determine to be necessary or desirable
or as directed by Council.
(3) Subject to the approval of the Council, have power
to enter into any agreement, compromise or settlement of any litigation
in which the Borough is involved.
(4) Render opinions in writing or verbally upon any question
of law submitted to him by the Council or any member thereof with
respect to their official powers and duties, and perform such duties
as may be necessary to provide legal counsel to the Council and Mayor
in the administration of municipal affairs.
(5) Supervise and direct the work of such additional attorneys
and technical and professional assistants as the Council may authorize
for special or regular employment in or for the municipality.
B. The following duties of the Borough Attorney shall
be covered by his annual retainer:
(1) Attendance at all public and caucus meetings of the
governing body.
(2) Preparation of all resolutions.
(3) Preparation of all ordinances and amendments to ordinances,
except bonding ordinances and except those which, because of the introduction
of some new concept or for other reason, will require extra service.
(4) Preparation of contracts which relate to the services
and purchases of municipal departments in the normal functions of
the municipal body.
(5) Rendering of legal opinions to and consulting with
the Mayor and Council and municipal department heads. Counsel would
be available for such consultations and legal opinions on all inquiries
by phone or by letter.

All other services shall be on a fee basis as
authorized by the Mayor and Council. All invoices for legal services
shall by subject to Council approval.
|
The Borough Council shall, from time to time
by resolution, designate a bonded official of the municipality to
make examinations of its records as to unpaid municipal liens and
to certify the results thereof. Said official, designated the "Tax
Search Officer," shall thereafter be vested with the power to make
official certificates of searches for municipal liens. The official
designated as the Tax Search Officer shall continue in that capacity
until a new resolution is passed by the Borough Council designating
a replacement, and no other official other than the Tax Search Officer
shall make any official certificate of municipal lien searches.
A physician shall be appointed by the Mayor,
with the consent of the Borough Council, to be known as the "Fire
Surgeon." He shall examine all members of the Fire Department and
all appointees to the Department whenever required by the Fire Committee
and shall report in writing the results of such examinations, with
his opinion as to the physical fitness for fire work of the person
examined. He shall be called whenever the services of a physician
are required by the Fire Department. Compensation of the Fire Surgeon
shall be fixed by the Borough Council. The Mayor may also appoint,
with the consent of the Borough Council, an alternate Fire Surgeon.

A physician shall be appointed by the Mayor,
with the consent of the Borough Council, to be known as the "Police
Physician." He shall examine all members of the police force and appointees
to the force whenever required by the Police Committee, and shall
report in writing the result of such examinations, with his opinion
as to the physical fitness for police work of the person examined.
He shall be called whenever the services of a physician are required
by the Police Department. The Mayor may also appoint, with the consent
of the Borough Council, an alternate Police Physician.

A. The position of part-time Borough Administrator of the Borough of
Park Ridge is hereby created, and employment of a qualified person
for that position is hereby authorized.
B. Method of appointment; term and qualifications.
(1) The Borough Administrator shall be appointed by the Mayor with the
advice and consent of the Council. The Borough Administrator's employment
shall be evidenced by a contract approved by the Mayor and Council.
(2) The term of office of the Borough Administrator shall be at the pleasure
of the Mayor and Council.
(3) The Borough Administrator may be removed by a two-thirds vote of
the Mayor and Council, the resolution of removal to become effective
three months after its adoption. The Mayor and Council may provide,
however, that the resolution shall have immediate effect, provided
that there shall be paid to the Administrator forthwith any unpaid
balance of his/her salary and his/her salary for the next three months
following adoption of the resolution.
(4) The Borough Administrator shall be appointed on the basis of administrative
qualifications, with special regard to education and training in government
affairs and experience therein. Members of the Mayor and Council may
not receive such appointment during their term or within two years
after the expiration of said term.
(5) The Borough Administrator shall be reviewed annually by the Personnel
Committee in November, and its performance evaluation report shall
be presented to the Mayor and Council and privately to the Borough
Administrator by the Council President.
C. Disability or absence. During any approved absence or disability
of the Borough Administrator, an officer or employee of the Borough
may be appointed by the Mayor and Council to temporarily perform the
duties and responsibilities of the position.
D. Compensation. The compensation of the Borough Administrator shall
be fixed by the Borough Council by appropriate ordinance.
E. Duties and responsibilities.
(1) The Borough Administrator shall work with the administrative team,
which shall include the Borough Clerk, the CFO and the Director of
Operations.
(2) The Borough Administrator shall have the responsibility and authority
to perform the following duties as may be assigned to him or her by
the Mayor with the consent of the Borough Council:
(a)
Serve as the chief administrative officer of the Borough.
(b)
Attend all meetings of the Mayor and Council and other boards,
as required, with the right to participate in all discussions, but
without the right to vote.
(c)
Advise the Mayor and Council on policy decisions.
(d)
Execute all laws of the State of New Jersey and execute ordinances
and resolutions of the Borough.
(e)
Recommend the appointment and/or removal of all employees for
whose selection and removal no other method is provided by law.
(f)
As instructed by the Council, negotiate contracts which are
subject to the approval of the Mayor and Council.
(g)
Represent, or so direct the administrative team to represent,
the Borough, with the approval of the Mayor and Council, in its relations
with the federal government, state, county and other municipalities
and assess the Borough's interest in contracts, franchises and other
business transactions.
(h)
Investigate the affairs of any officer, employee or department
at the request of the Mayor and Council or the Board of Public Works,
as appropriate, and report thereon.
(i)
Working with the residents of the Borough, ensure that all resident
inquiries or complaints are properly followed up by the appropriate
Borough Department.
(j)
Work with the Borough Clerk, CFO and Director of Operations
to establish and maintain effective personnel practices and maintain
appropriate records of all employees, including the development of
a systematic review of employee performance.
(k)
Carry out, or so direct the administrative team to carry out,
all policies established by the Mayor and Council.
(l)
Oversee and disseminate information to the Mayor and Council.
(m)
Working with the CFO, prepare the annual and capital budgets,
in consultation with department heads, and submit them to the Mayor
and Council at a date in accordance with procedures established by
the Council.
(n)
Working with the Mayor and Council, CFO, Borough Clerk and Director
of Operations, annually establish the priority of capital projects
needed in the Borough, research the projects and budget the necessary
funding to adequately and realistically complete the projects in a
prudent and expedient time frame.
(o)
Working with the Borough Clerk, receive copies of all reports
and documents required by the Mayor and Council of all Borough department
heads, officers, employees, committees, commissions, authorities and/or
contractors/vendors.
(p)
Working with the Director of Operations, the CFO and the Borough
Clerk, develop procedures for the purchase and distribution of materials,
supplies and equipment.
(q)
Serve as one of the Borough's purchasing agents. In such capacity,
the Borough Administrator shall purchase, in accordance with the provisions
of the governing statutes and generally accepted purchasing practices,
all supplies and equipment for the various agencies, boards, departments
and other offices of the Borough.
(r)
Delegate to such individuals, officers or departments as may
be appropriate, as he or she may deem necessary for the efficient
administration of the Borough.
(s)
Keep the Mayor and Council informed as to federal aid projects
and state aid projects and any other aid programs or grants that the
Borough may qualify for.
(t)
Perform such other duties as may be required by ordinance, resolution
or direction of the Borough Council.
(u)
Work with the Director of Operations and Board of Public Works
with respect to the financial, personnel, administrative and office
operations of the Electric Utility Department and Water Utility Department.
The Borough Administrator shall report to the Mayor and Council on
all other matters.
F. Consistence with law. Nothing herein shall derogate from or authorize
the Borough Administrator to exercise the powers and duties of elected
officials of the Borough and of the boards and agencies thereof established
pursuant to law.

A Municipal Disaster Control Director shall
be appointed by the Mayor from among the residents of the Borough.
The term of office of the Municipal Disaster Control Director shall
be for three years from the first day of January in the year in which
he or she was appointed.

A. It is ordained and established that the position of
Rate Counsel be created within the Borough of Park Ridge.
B. The position of Rate Counsel shall be for a period
of one year and shall be held by an attorney licensed to practice
law in the State of New Jersey. The attorney shall be appointed by
the Mayor and Council of the Borough of Park Ridge. The Board of Public
Works and Public Utilities Personnel Committee may make a recommendation
to the Mayor and Council as to the Rate Counsel. The compensation
for the Rate Counsel shall be paid from the annual budget of the Department
of Public Works and Public Utilities.

C. The Rate Counsel so appointed need not be a resident
of the Borough of Park Ridge.
D. The duties of Rate Counsel shall include giving legal
counsel, representation, advice and opinions where required by the
Board of Public Works as to any issue directly or indirectly affecting
the Board, the establishment, continuance and creation of electric
or water rates in the Borough of Park Ridge, management of the Department
of Public Works and Public Utilities and any other related issues
referred to Rate Counsel by the Board.

A. It is ordained and established that the position of
Rate Engineer be created within the Borough of Park Ridge.
B. The position of Rate Engineer shall be for a period
of one year and shall be held by a licensed engineer of the State
of New Jersey. The engineer shall be appointed by the Mayor and Council
of the Borough of Park Ridge. The Board of Public Works and Public
Utilities Personnel Committee may make a recommendation to the Mayor
and Council as to the Rate Engineer. The compensation for the Rate
Engineer shall be paid from the annual budget of the Department of
Public Works and Public Utilities.

C. The Rate Engineer so appointed needs not be a resident
of the Borough of Park Ridge.
D. The duties of the Rate Engineer shall include giving
advice and other services where required by the Board of Public Works
as to any issue directly or indirectly affecting the Board, the establishment,
continuance and creation of electric or water rates in the Borough
of Park Ridge, management of the Department of Public Works and Public
Utilities, water and electric system requirements and design and other
related issues referred to the Rate Engineer by the Board.

A. Pursuant to N.J.S.A. 40A:9-140.10, the Mayor and Council
of the Borough of Park Ridge hereby create the position known as "Chief
Financial Officer."
B. The Chief Financial Officer as created by this section
shall have all of the responsibilities as so designated by state statute,
N.J.S.A. 40A:9-140.1 et seq.
C. The Chief Financial Officer shall be certified as
a financial officer by receiving from the Division of Local Government
Services a Municipal Finance Officer certificate representing that
the person is qualified for that certificate pursuant to law.
D. The Chief Financial Officer shall be compensated in
accordance with this chapter of the Code of the Borough of Park Ridge.
E. The Chief Financial Officer who has received the certificate
shall ensure that the certificate is continually in full force and
effect, and he shall not let the certificate lapse.
F. The Treasurer, appointed pursuant to Article
II, §
2-25, of the Borough of Park Ridge Administrative Code, shall be the Chief Financial Officer of the Borough of Park Ridge, provided that the Treasurer qualifies in accordance with N.J.S.A. 40A:9-140.1 et seq.
G. The Chief Financial Officer may be removed for failure
to qualify as a Chief Financial Officer and for all other reasons
provided by law.
There shall be such other appointive officers
as the Council may deem necessary. Such other positions shall be established
by ordinance, and such officer shall be appointed by the Mayor, with
the advice and consent of the Council. Terms shall be one year and
until their successors have been appointed and qualified.

A. The Board of Public Works, as established by this
article, shall have the duties vested in it by the Mayor and Council
of the Borough of Park Ridge pursuant to N.J.S.A. 40:A-60-7. The Board
is specifically vested with the power to provide for the proper maintenance
and operation of the water, electric, public works and sanitary sewer
system owned or operated by the Borough of Park Ridge and to employ
such professional advisors in the manner set forth in this article.
All laws now in force or in any way applicable to the rights, privileges
and duties vested in or imposed upon the Mayor and Council of the
Borough of Park Ridge are hereby continued in full force and made
applicable to the Board of Public Works. The Board is further vested
with the authority to examine the water and electric rates to become
effective upon approval of the Mayor and Council and changes in water
rates to become effective upon approval by the Board of Public Utilities
of the State of New Jersey after approval of the Mayor and Council.
The Board shall submit to the Mayor and Council, in conjunction with
any proposed utility rate change, written explanations which set forth
the reasons necessary for the rate change to be made.
B. From time to time, the Board shall recommend to the
Mayor and Council increases in water or electrical rates to be charged
to the users of these utilities. These recommendations shall be in
writing, with a written explanation why the rate changes are necessary,
and shall be the recommendation of 2/3 of the membership of the Board
of Public Works. The Mayor and Council shall, upon receipt of these
recommendations, adopt an ordinance which shall be the legislation
necessary to create any rate changes as proposed by the Board of Public
Works, unless 2/3 of the authorized membership of the governing body
refuses to adopt such an ordinance.
C. Sale or
lease of public utility systems.

(1) In
the event that the Mayor and Council of the Borough of Park Ridge
adopt an ordinance to either lease or sell the public water utility
and/or electric utility system public utility system(s), the approval
of such action shall be subject to a public referendum approved by
a majority of the legal voters voting in such election in accordance
with N.J.S.A. 40:62-3 et seq.
(2) In
the event that the Mayor and Council of the Borough of Park Ridge
adopt an ordinance to either lease or sell its public utility system(s)
in accordance with N.J.S.A. 40:62-3 et seq., and same is subsequently
approved by a majority of the legal voters voting in a public referendum
to be held at the next general election, then in such event, a majority
vote of the members of the Council then present at such meeting shall
be required to dissolve the Park Ridge Board of Public Works. This
shall be the only method to dissolve the Park Ridge Board of Public
Works.

A. The Board of Public Works and Public Utilities is
specifically authorized to create a Personnel Committee, which shall
consist of three members. Two members of the Personnel Committee shall
be members of the Board, designated by the Board, and the third member
shall be the Council liaison to the Board of Public Works. It shall
be the sole function of this Personnel Committee to recommend to the
Mayor and Council the hiring of personnel. The Personnel Committee
is specifically charged with the responsibility to recommend to the
Mayor and Council by the reorganization date of the Mayor and Council
each year or within two weeks thereof a recommendation for the hiring
of a rate counsel and a rate engineer.
B. Upon receipt of the recommendation of the Board of
Public Works and Public Utilities Personnel Committee as to the hiring
of Rate Counsel and a Rate Engineer, the Personnel Committee shall
certify to the Mayor and Council that there is or will be sufficient
budget funds available to pay for these professionals.

C. The Board of Public Works and Public Utilities Personnel
Committee shall notify the Mayor and Council of vacancies in existing
personnel positions that were approved as part of the annual budget.
The Personnel Committee may make recommendations to the Mayor and
Council when hiring a person to fill the vacancy. The Mayor and Council
shall appoint the individual to fill the vacancy.
