The code entitled the "Swimming Pool Code of
New Jersey, 1970," approved by the State Department of Health of New
Jersey, is hereby adopted by the Board of Health of the Borough of
Park Ridge in its entirety, under the authority of N.J.S.A. 26:3-69.1
to 3-69.6, inclusive.
The printing of said code in book form is hereby
authorized, and a copy of said printed code is annexed hereto and
made a part hereof by reference thereto, as though set forth at length
in this chapter.
Three copies of said code have been placed on
file in the office of the Secretary of the Board of Health, pursuant
to the provisions of N.J.S.A. 26:3-69.2, for use and examination by
the public so long as this chapter shall remain in effect.
Any person or entity who violates any provision
of the code hereby adopted shall be subject to a fine of not less
than $5 nor more than $500, for the first offense, and for subsequent
offenses shall be subject to such penalties as are provided in the
New Jersey statutes.
The Municipal Court of the Borough of Park Ridge
shall have jurisdiction over proceedings to enforce and collect any
penalty imposed because of the violation of any provision of said
code. The proceeding shall be summary and in accordance with the Penalty
Enforcement Law (N.J.S.A. 2A:58-1 et seq.). Process shall issue at the suit of the Board of Health
or the Regional Health Commission and shall be either in the nature
of a summons or a warrant.
