A. There is hereby established in the Borough of Pemberton
a State Uniform Construction Code enforcing agency to be known as
the "Division of Inspection," consisting of a Construction Official,
Building Subcode Official, Plumbing Subcode Official, Electrical Subcode
Official, Fire Protection Subcode Official and such other subcode
officials for such additional subcodes as the Commissioner of Department
of Community Affairs, State of New Jersey, shall hereafter adopt as
part of the State Uniform Construction Code. The Construction Official
shall be the chief administrator of the enforcing agency.
B. Each official position created in Subsection
A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended, and N.J.A.C. 5:23, provided that, in lieu
of any particular subcode official, an on-site inspection agency may
be retained by contract pursuant to N.J.A.C. 5:23. More than one such
official position may be held by the same person, provided that such
person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23
to hold each such position.
C. The public shall have the right to do business with
the enforcing agency at one office location, except for emergencies
and unforeseen or unavoidable circumstances.
All appeals will be handled by the Burlington
County Board of Appeals.

The fee for a construction permit shall be the
sum of the subcode fees listed in Subsections A through D hereof and
shall be paid before the permit is issued.
A. Building subcode fee. The building subcode fee shall
be:
(1) For new construction, the permit fees shall be computed
at the rate of $0.027 per cubic foot of volume. However, structures
falling into S-1 or S-2 categories shall be charged at the rate of
$0.030 per cubic foot, except that the minimum fee in all cases shall
be $35.
(2) For
alterations, renovations and repairs, the permit fees shall be based
upon the estimated cost of the work and shall be in the amount of
$30 per $1,000 of estimated cost, up to and including $50,000; from
$50,001 to and including $100,000, the additional fee shall be in
the amount of $25 per $1,000 of estimated cost; above $100,000, the
additional fee shall be in the amount of $20 per $1,000 of estimated
cost. For the purpose of determining estimated cost, the applicant
shall submit to the enforcing agency, if available, cost data produced
by the architect or engineer of record or by a recognized cost-estimating
firm or by the contractor. A bona fide contractor’s bid, if
available, shall be submitted. The enforcing agency shall make the
final decision regarding estimated cost. There shall be a minimum
fee of $50 for any permit under this section.
(3) For
additions, permit fees shall be computed the same as for new construction,
$0.035 per cubic foot of volume, except that the minimum fee shall
be $50.
(4) For
additions and alterations, permit fees shall be the sum of the respective
fees for alterations and additions computed separately.
B. Plumbing subcode fee. The fee for the plumbing subcode
shall be the fee mandated by the state for a third-party agency, but
no less than $50.
C. Electrical subcode fee. The fee for the electrical
subcode shall be the fee mandated by the state for a third-party agency,
but no less than $50.
D. Fire subcode fee. The minimum fee for the fire subcode
shall be $50. Other fire subcode fees are as follows:
(1) For plan review to establish firesafety: $50.
(2) For inspection of new homes: $50.
(3) For inspection of newly installed wood stoves or fireplaces
or new or rebuilt chimneys: $60.
(4) For inspection of smoke detectors:

(a)
Up to 100 gallons, not to include drums or gas
cans: $60.
(b)
For each additional 500 gallons or fraction

(7) For inspecting fire hazards, such as boilers, fire-suppression
systems, fire hose cabinets, fire alarms and standpipes, per visit:
$60.

The fee for plan review shall be 5% of the amount
charged for the construction permit. The fee for plan review of a
consultative nature where no immediate construction is planned shall
be 20% of the estimated cost of the construction permit for such work
or $50, whichever is higher.

The fee for a permit for demolition of a building
or structure shall be $150 for one- or two-family residences, $75
for garages, storage sheds and tanks, and $250 for commercial warehouses
and all other buildings or structures.

A. The fee for a permit for the removal of a building
or structure from one lot to another or to a new location on the same
lot shall be $10 per $1,000 of the sum of the estimated costs for
moving, for new foundations and for placement in a complete condition
in the new location, except that the minimum fee shall be $50.
B. The fee or structural inspection of an existing dwelling
shall be $50.

The fee for a permit to construct a sign shall
be $2 per square foot of the surface area of the sign, except that
the minimum fee shall be $50.

The following fees shall be charged for certificates
of occupancy:
A. New home: 10% of the construction permit fee, but
not less than $50.
D. Continued occupancy: $50.
E. Temporary occupancy: none.

The Construction Official shall, with the advice
of the subcode officials, prepare and submit to the Borough Council
biannually a report recommending a fee schedule based on the operating
expenses of the agency and any other expenses of the municipality
fairly attributable to the enforcement of the State Uniform Construction
Code Act.

As required by the Department of Community Affairs,
the enforcing agency shall collect, in addition to the fees specified
above, a surcharge fee of $0.0016 per cubic foot of volume of new
construction, and $0.80 per $1,000 of construction costs of all other
permits. Such surcharge fee shall be remitted to the Bureau of Housing
Inspection, Department of Community Affairs, on a quarterly basis
for the fiscal quarters ending March 31, June 30, September 30 and
December 31, and not later than one month next succeeding the end
of the quarter for which it is due. In the fiscal year in which the
regulations first become effective, such fee shall be collected and
remitted for the third and fourth quarters only.

The enforcing agency shall report annually,
at the end of each fiscal year, to the Bureau of Housing Inspection,
and not later than July 31, the total amount of the surcharge fee
collected in the fiscal year. In the fiscal year in which the regulations
first become effective, such report shall be for the third and fourth
quarters only.

Fire limits shall be determined at a later date;
except, however, that the Construction Official shall prepare and
submit to the Borough Council of the Borough of Pemberton, biannually,
a report reevaluating the delineation of any fire limits herein determined.
This report shall indicate the recommendations of the Construction
Official, the Building Subcode Official and the Fire Subcode Official
regarding those areas which should be designated as within fire limits,
with the reasons therefor.
