The Township of Pennsauken hereby establishes this chapter to regulate
the speed of any railroad train through the boundaries of the Township of
Pennsauken.
Since it has been determined that the appropriate safeguards as indicated
in N.J.S.A. 48:12-48 have not been established along any railroad line through
the Township of Pennsauken, it shall therefore be unlawful for any railroad
train or other railroad vehicle to travel on any railroad line which intersects
or runs through any property within the Township of Pennsauken at a rate of
speed in excess of 39 miles per hour. This prohibition shall extend to any
railroad company, whether governmentally owned and operated or privately owned
and operated, whose employee or agent shall drive the aforesaid railroad vehicle
through the Township of Pennsauken at speeds in excess of 39 miles per hour.
Any person, company or any other entity which shall violate any of the
provisions of this chapter shall be subject to one or more of the following:
a fine not exceeding $1,250 or imprisonment in the county jail for a term
not exceeding 90 days, or a period of community service not exceeding 90 days,
at the discretion of the Municipal Court Judge of the Township of Pennsauken,
or both, at the discretion of the court.
This is a penal chapter, and said chapter shall be enforced by the police
officers of the Police Department of the Township of Pennsauken.
