All standards and restrictions set forth in this Part 1 shall be interpreted and applied as minimum requirements. Nothing herein contained shall be construed to prohibit or prevent the use of higher or more restrictive standards or requirements that may appear in any other lawfully applicable statutes, ordinances, regulations, rules, deed restrictions or covenants.
Whenever the clear context of this Part 1 does not require a contrary interpretation, this Part 1 shall be read in pari materia with Chapter 90, Construction Codes, Uniform, as adopted, amended and supplemented. Specifically, the Construction Official, as referred to therein, shall have all the powers and duties of the Building Inspector under this Part 1.
Whenever the definitions, terms or provisions of the Municipal Land Use Law, P.L. 1975, c. 291 (N.J.S.A. 40:55D-1 et seq.), are inconsistent with the definitions, terms or provisions of the Part 9, Zoning; Part 8, Subdivision of Land; Part 6, Site Plan Review, and Part 7, Soil Removal, readopted hereby, the provisions of P.L. 1975, c. 291, shall govern, including, without limitation, the time periods therein provided, the penalty provided by N.J.S.A. 40:55D-55 for transfer or sale of land without subdivision approval and any governing statutory procedural requirements.
This Part 1 is intended to constitute the comprehensive Zoning, Subdivision, Site Plan, Joint Planning Board and Land Use Regulation Ordinances of the Township of River Vale, and all prior ordinances or parts of ordinances that are not incorporated into or adopted by reference or readopted by this Part 1 and that are inconsistent with the provisions of this Part 1 are hereby repealed.
Notwithstanding the repealer of prior ordinances as set forth in § 142-62, all applications for development properly and timely made pursuant to said prior ordinances prior to the effective date of this Part 1 may be continued, but shall be processed in accordance with the substantive and procedural requirements of this Part 1.
For appeals to the Township Council, as provided in this Part 1, the administrative officer shall be deemed to be the Township Clerk.
