There is hereby established a Seaside Heights
Tourist Development Commission, which shall be an official agency
of the Borough of Seaside Heights.
The Commission shall consist of five members,
who shall be appointed by resolution of the Borough Council. One member
shall be a designated representative of the Mayor and Council, who
shall advise the governing body of the work of the Commission and
who shall serve at the Mayor and Council's pleasure. The remaining
four members of the Commission shall be appointed in the same manner
but shall be individuals upon whom the additional assessment or licensing
fees hereinafter established shall be imposed. The term of said remaining
four members of the Commission shall be for two years, except that
of the members first appointed, two shall be appointed for terms of
one year and two for terms of two years. If any vacancy occurs on
the Commission other than by expiration of term, it shall be filled
for the unexpired term in the same manner as the original appointment.
No members of the Commission shall be compensated for the performance
of their Commission duties.

There shall be an additional fee assessment against all licenses issued under Chapter
122 of the Code of the Borough of Seaside Heights, against all alcoholic beverage licenses issued pursuant to N.J.S.A. 33:1-19 and against all amusement games licenses issued pursuant to N.J.S.A. 5:8-100 et seq. Said fee shall be payable to the Borough of Seaside Heights and shall be in the amount of 50% of the current license fee up to a maximum of $200. The Borough shall create a fund from the revenues collected under this chapter and that fund shall be held by the Seaside Heights Tourist Development Commission.
The Seaside Heights Tourist Development Commission
shall have the exclusive authority to disburse all of the revenues
allocated to the Tourist Development Fund herein established. It shall
spend moneys from the Fund in a manner it deems advisable for the
purpose of publicizing and otherwise promoting the Borough of Seaside
Heights in order to attract tourism; however, at least 50% of the
revenues from the Fund shall be disbursed for advertising outside
the municipality to attract tourists into the municipality, which
is deemed to be a public purpose.
The Seaside Heights Tourist Development Commission
shall keep records of its meetings, activities and expenditures. At
any time upon request of the governing body and in no event less than
once annually, the Commission shall make a report based on its records.
The governing body shall examine the report to determine whether all
disbursements from the Fund have been made for the purpose hereinabove
stated. If the governing body shall determine that disbursements were
not made pursuant to the stated purpose of the act, it may, by resolution
stating the reasons therefor, remove any and all members of the Commission.
