A parent, guardian or other person having legal custody of an infant
under 18 years of age who fails or neglects to exercise reasonable supervision
and control of the conduct of such infant shall be liable for any willful,
malicious or unlawful injury or destruction by such infant of real or personal
public property of the Borough of Seaside Heights.
Whenever the real or personal property of the Borough of Seaside Heights
is destroyed or damaged by any willful, malicious or unlawful act of a minor,
the Borough Council may authorize the institution of legal proceedings in
civil court to hold the parent, guardian or other person having legal custody
of the infant under 18 years of age liable for the damage caused to the real
or personal property of the borough where such a parent, guardian or other
person has failed or neglected to exercise reasonable supervision and control
over the conduct of such infant under 18 years of age.
The provisions of this chapter shall not apply to parents from whom
parental custody and control of such infant has been removed by court order,
decree, judgment, military service or marriage of such infant.
