In accordance with N.J.S.A. 40:67-16.9, the Mayor of the Borough of Tuckerton shall provide for the closing of any municipal street, or portion thereof, to motor vehicle traffic on any day or during any specified hours on any day whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.
A. 
Prior to the closing of any municipal street, in accordance with this chapter, the Mayor shall confer with the Director of Police and the Council member in charge of streets and roads concerning the municipal street to be closed and the duration of the closure of said municipal street.
B. 
In the event that the Mayor, acting under the authority of this chapter, determines that the municipal street, or portion thereof, should be closed for a specified period of time, the Mayor shall direct that proper warning signs of such closing be posted on any municipal street, or portion thereof, during the time that municipal street, or portion thereof, is closed.
A. 
Any person violating or failing to comply with any other provision of this article shall, upon conviction thereof, be punishable by a fine not to exceed $1,000, by imprisonment not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service, as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
B. 
The violation of any provisions of this article shall be subject to abatement summarily by a restraining order or injunction issued by a court of competent jurisdiction.
