The properly identified authorized agents of the Borough shall
have the right of access to the premises served at all reasonable
hours for the purpose of examining fixtures and pipes and for any
other purpose which is proper and necessary in the conduct of the
business of this chapter.
No plumber, owner, tenant or other unauthorized person shall
connect or disconnect a water and/or sewer connection without the
written consent of the Borough.
No agent or employee of the Borough has authorization to bind
it by any promise, agreement or representation not provided for in
these rules.

A. All water and sewer connections including fixtures furnished by the
property owner and located on the property of the property owner shall
be maintained by the property owner in good order and all fixtures
owned by the Borough of Tuckerton Water and Sewer Department located
on the property owner's property, public right-of-way, or a Borough
of Tuckerton easement shall be properly maintained by the property
owner. In the event that the fixture (water curb box, water meter
pit, water meter and accessories whether located in a water meter
pit or inside a dwelling and/or sewer cleanout) becomes damaged, the
property owner shall be responsible for all repairs and/or replacements
of said fixtures in accordance with the rules and regulations of the
Borough of Tuckerton Water and Sewer Department. The Borough of Tuckerton
shall be responsible to repair and/or replace any fixture that is
the property of the Borough that is failing due to normal wear and
tear at no cost to the property owner.
B. All dwellings, commercial, industrial or other buildings connected
to the sewer system shall provide, as an integral part of the plumbing
system, a stack vent not less than 10 feet above grade. Ground-level
curb or yard vents are prohibited and shall not be connected to the
sewer system.
C. Sewer lateral ownership and responsibility:
(1) The property owner owns the sewer lateral from the building to the
curb or edge of pavement. The Borough of Tuckerton owns the sewer
lateral from the curb or edge of pavement to the sewer main.
(2) The property owner is responsible to maintain the sewer lateral in
a safe and watertight condition from the building to the curb or edge
of pavement. The Borough of Tuckerton shall be responsible to maintain
the sewer lateral from the curb or edge of pavement to the sewer main
in a safe and watertight condition.
(3) The property owner shall be responsible for and bear the cost of
all maintenance of the sewer lateral cleaning and removal of obstructions
which shall include, but are not limited to, tree roots, grease, etc.,
from the building or structure to the Borough of Tuckerton sewer main.
The property owner shall further be responsible for and bear the cost
of repairs between the building or structure and the curb or edge
of pavement. The Borough of Tuckerton shall be responsible to make
repairs of the sewer lateral from the curb or edge of pavement to
the sewer main. Should a blockage occur, the property owner shall
notify the Borough of Tuckerton Water and Sewer Department which shall
make an inspection of the sanitary sewer main in the street or right-of-way
easement. Should the sanitary sewer main be blocked, then the Borough
of Tuckerton shall be responsible to clear the blockage. Should the
sanitary sewer main not be blocked then the property owner shall be
advised that the blockage is in the sewer lateral from the sewer main
to the building. It shall be the responsibility of the property owner
to clear the blockage from the building to the sanitary sewer main.
All work is to be performed by a licensed plumber.
(4) In the event that the sewer lateral blockage is the result of a broken
or separated pipe, etc., of the sewer lateral from the building to
the curb or edge of pavement, then the property owner shall be responsible
to make the necessary repairs in order to return the lateral to proper
operation. The repairs to the sewer lateral shall be done immediately
so as to return the lateral back to normal operation, not allowing
sewage to escape. Should a sewer spill occur as a result of a broken
lateral owned by the property owner, the Borough of Tuckerton shall
be notified immediately. The Borough shall not be responsible for
any damage done by sewage escaping from the lateral or fixtures of
the portion of the sewer lateral owned by the property owner. All
repairs to the sewer lateral owned and maintained by the property
owner shall be performed by a licensed plumber. The plumber shall
not backfill the trench until the work has been inspected and approved
by the Borough. Any work not acceptable to the Borough shall be immediately
removed and replaced with work that is acceptable.
(a)
At the time of inspection, should a sewer cleanout not exist
at the curb, the property owner shall be responsible, at the owner's
expense, to install a cleanout in accordance with the Borough of Tuckerton
rules and regulations. The purpose of the cleanout at the curb will
allow the Borough of Tuckerton personnel the ability to televise the
lateral after the blockage of the lateral has been cleared, to inspect
for any defects that may be causing the blockage, which the Borough
would be responsible to repair at no cost to the property owner. Should
no defects of the sewer lateral be noted at the time of the inspection
that would cause a blockage will result in the property owner assuming
the responsibility of the cleaning of the lateral from the building
to the sanitary sewer main in the street. The inspection by the Borough
of Tuckerton of the sewer lateral would be performed for each occurrence.
Failure to have the cleanout at the curb installed will result in
the property owner being responsible to clear blockages from the building
to the sanitary sewer main in the street without the ability for and
inspection by the Borough of Tuckerton.
(b)
Failure by the property owner to repair the sewer as described herein shall be subject to the provisions of §
249-42, Violations and penalties, of the Tuckerton Code. In the event that as a result of a broken pipe, blockage, etc., that causes a sewer spill, the property owner may be subject to penalties pursuant to the New Jersey Department of Environmental Protection and the Ocean County Board of Health.
D. Water service ownership and responsibility.
(1) The property owner owns the water service from the building to the
water meter pit and/or curb stop valve and shall be responsible to
bear all cost for the proper maintenance and repair of the water service.
All leaks in the water service owned by the property owner must be
repaired immediately. All work performed on the water service shall
be by a licensed plumber. The licensed plumber shall not backfill
the trench until work has been inspected and approved by the Borough.
Any work not acceptable by the Borough shall be immediately removed
and replaced with work that is acceptable.
(2) The Borough of Tuckerton owns the water service from the water meter
pit and or curb stop valve to the water main and shall be responsible
to properly maintain that portion of the water service including the
water meter and accessories, water meter pit and/or curb stop valve
providing that the fixtures have not been damaged. Furthermore, the
Borough of Tuckerton owns the water meter and accessories located
in the dwelling and is responsible to properly maintain them providing
that they have not been damaged.

(a) The Borough of Tuckerton owns the water meter, including the remote
wire (and accessories) located in the dwelling, and is responsible
to properly maintain them, providing that they have not been damaged.
The property owner is responsible to maintain the connections on both
the inlet and outlet of the water meter, including but not limited
to yokes, valves, fittings, etc. The property owner is responsible
to protect the water meter from freezing. Should the water meter have
to be removed for maintenance or repair of the connections to the
water meter, the property owner shall contact the Borough of Tuckerton
in order that the water meter can be removed and reinstalled once
the maintenance and/or repair has been made. Under no circumstances
shall the property owner remove the water meter.
(b) Should the Borough of Tuckerton's property become damaged from neglect
or abuse, the property owner is responsible to pay for the replacement
or repair of the facilities in accordance with the Borough of Tuckerton's
schedule of rates and charges.
(3) Failure by the property owner to repair the water service as provided herein shall be subject to the provisions of §
249-42, Violations and penalties, of the Tuckerton Code.
Anyone found to have discharged such prohibited substances to
the sanitary sewer system shall be liable for, charged and shall pay
for all damages to the system for cleanup, repairs and replacement
of Borough facilities and the Borough's costs for investigation, detection
and enforcement, in addition to fines and penalties as provided for
in this chapter.
