Tullytown Borough is hereby divided into districts
of different types, each type being of such number, shape, kind and
area, and of such common unity of purpose and adaptability of use
that are deemed most suitable to carry out the objectives of this
chapter. Every parcel of land and every building or other structure
in the Borough, except as otherwise provided by law or by ordinance,
shall be subject to the regulations, restrictions and requirements
specified for the district in which it is located.
The districts are established and designated
as follows:
A. Zoning Districts.
(1) R-1 District - Residential 1.
(2) R-2 District - Residential 2.
(3) BC District - Borough Center.
(4) SC District - Shopping Center.
(5) HC District - Highway Commercial District.
(6) LI District - Light Industrial.
(7) SWD District - Solid Waste Disposal.
(8) SWS District - Solid Waste Staging.
B. Flood Hazard Area.
(1) FW District - Floodway District.
(2) FF District - Flood-Fringe District.
(3) AF District - Approximate Flood District.
Districts are bounded and defined as shown on
the accompanying map entitled "Zoning Map." The "Flood Boundary and
Floodway Map," provided by FEMA with all explanatory matter thereof,
is hereby made a part of this chapter. The "Flood Boundary and Floodway
Map" is based upon the map prepared by the United States Department
of Housing and Urban Development, Federal Insurance Administration,
Flood Boundary and Floodway Map (Community Panel No. 420206 May 18,
1999) as amended, and is hereby incorporated into this chapter. The
Flood Boundary and Floodway Map is an overlay to the Zoning Map, and
the requirements of both districts shall apply.
Where uncertainty exists with respect to the
boundaries of the district as indicated on the Zoning Map, the following
rules shall apply:
A. Where district boundaries are indicated as approximately
coinciding with the center lines of streets, highways, railroad lines,
or streams, such center lines shall be construed to be such boundaries.
B. Where district boundaries are so indicated that they
approximately coincide with lot lines, such lot lines shall be construed
to be said boundaries.
C. Where district boundaries are so indicated that they
are approximately parallel to center lines of streets or highways,
such district boundaries shall be construed as being parallel thereto
and at such distance therefrom as indicated on the Zoning Map.
D. Where district boundaries divide a lot, the locations
of such boundaries are deemed to be lines which connect two identification
points.
E. Because floodwaters follow the precise topography
of the land and because of the impracticality of showing precise topography
on a small scale map, the flood profiles which accompany the most
recent Flood Insurance Study (US Department of Housing and Urban Development,
Federal Insurance Administration) are hereby incorporated in this
chapter.
F. Where interpretation is needed concerning the exact
location of any boundary of the Flood Hazard Area, the Zoning Hearing
Board shall make the necessary determination after consulting with
the Planning Commission and Borough Engineer.
Participation in the National Flood Insurance
Program is mandatory in Pennsylvania under Act 166 of October 4, 1978,
P.L. 851, No. 1978-166 (32 P.S. §§ 679.101 to 679.601).
As such, the Borough hereby agrees to perform whatever administrative
functions that are mandatory by law including the requirement to forward
all proposed amendments of these regulations to the Administrator
of the National Flood Insurance Program and the appropriate state
agency, prior to adoption.
