For the purpose of these regulations, unless a contrary intent clearly
appears, the following terms and words shall have the following meanings:
HORSE
Any horse, foal, pony, mule or burro.
STABLE
Any building or shelter or any part of a building or shelter used
to house one (1) or more horses.
WINDOW
Any window in a wall or in a door.
No person shall erect, occupy or use for a stable any building, structure
or land for the housing of one (1) or more horses in the Town of Dennis unless
such use is authorized and licensed by the Board of Health under the authority
of MGL C. 111, § 155.
The license shall become effective January 1 for each calendar year
and shall expire on December 31 of that year. The fee of said license shall
be as determined by the Board of Health.
No person shall erect, occupy or use a building or structure for a stable
unless such stable is unattached and thirty (30) feet distant from a dwelling
or any structure used for human habitation.
Every horse shall have stable facilities; and no horse shall be allowed
to remain out of doors all of the time without having access to proper shelter.
No horse shall be pastured on any land unless said land is at least
thirty (30) feet distant from an abutter's dwelling or any structure
used for human habitation. Also, said land must be adequately fenced to prevent
horses from causing damage to shrubbery or other property on an abutter's
land or becoming untendered on ways or highways to which the public has access.
Each stall shall be of adequate size so the horse stalled in the same
shall have room to comfortably lie down or stand up.
There shall be at least two (2) windows in every stable.
There shall be adequate drainage, either natural or artificial, for
urine and other waste matter in every horse stall. All drainage, sewage, rodent
and insect control, manure handling and disposal, etc., shall be in accordance
with all applicable regulations of the Commonwealth of Massachusetts, Department
of Public Health and/or Town of Dennis Board of Health regulations.
The flooring in each stall shall be of two-inch thick or more wood planking,
spaced sufficiently to allow for drainage, with sand not less than one (1)
foot deep beneath it.
