It shall be the duty of all owners of property to trim and keep trimmed all shrubs and trees growing upon such property and/or upon the grass plots along the abutting sidewalk, as follows:
A. 
So that no portion of any overhanging branch or limb or foliage shall have a clearance of less than eight feet above the surface of the sidewalk or of less than 14 feet above the surface of the cartway of any street, alley or highway;
B. 
So that no portion of any such shrub or tree less than eight feet above the surface of the sidewalk shall extend or encroach into the sidewalk area so as to obstruct or occupy any portion thereof; and
C. 
So that nothing but grass or ground ivy or similar low level vegetation not to exceed six inches in height is allowed to grow, and no other objects are placed, in the area lying between the street cartway and the sidewalk adjacent thereto, or if no sidewalk has been installed, the area lying within 10 feet of the curbline, so that such area between the street cartway and the sidewalk shall be left free and clear of all trees, bushes, structures, fences, large stones or other items except such grass or ground ivy or similar low level vegetation not to exceed six inches in height. Mature trees already existing at the time of this amendment (9-11-1995) may be left in place which, in the opinion of the Zoning Officer, pose no safety hazard and, in the opinion of the Superintendent, present no problems regarding utilities.

If any owner of property within the Borough shall fail to trim any shrub or tree as required by § 248-2 of this chapter within five days after notice from the Borough Council so to do, the Council shall have authority to cause such shrub or tree, as the case may be, to be trimmed in conformity with such notice and to collect the cost of such trimming, the minimum cost of which shall be not less than $100 with an additional charge of 10% of the actual cost from such property owner in default.

Any owner of property within the borough who shall violate any of the provisions of this chapter or who shall fail to conform to any notice given to such property owner pursuant to this chapter shall, upon conviction thereof before the District Justice, be sentenced to pay a fine not exceeding $600, plus costs of prosecution for each offense.
