[Adopted 4-11-1990 by Ord. No. 1990-1 (Ch. 5, Part 4, of the 1990 Code)]
There is hereby adopted by the Board of Commissioners of the Township of Swatara for the purpose of establishing rules and regulations to secure the proper installation of systems for furnishing potable water, for sanitary sewage disposal and storm drainage; and to insure public safety, health, and welfare as affected by the installation and maintenance of plumbing, and providing for permits and penalties, that certain plumbing code known as the BOCA National Plumbing Code, recommended by the Building Officials and Code Administrators, International, Inc., being particularly the Seventh Edition, 1987, of which not less than three copies have been and are now filed in the office of the Secretary of the Township of Swatara, Township Municipal Building, 599 Eisenhower Boulevard, Harrisburg, Pennsylvania, as the Plumbing Code of Swatara Township, and each and all of the regulations, provisions, penalties, conditions, and terms of the BOCA National Plumbing Code, Seventh Edition, 1987, are hereby referred to, adopted, and made part thereof, with additions, insertions, deletions, and changes, if any, hereinafter set forth, and the same are hereby adopted and incorporated as fully as if set forth at length herein, and from the date on which this article shall take effect, the provisions thereof shall be controlling in the installation and maintenance of plumbing systems within the corporate limits of the Township of Swatara.
Nothing in this article or in the plumbing code hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred, nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby; nor shall any right or remedy of any character be lost, impaired or affected by this article.
The invalidity of any section or provision of this article or of the plumbing code hereby adopted shall not invalidate other sections or provisions thereof.
In interpreting and applying the provisions of this code, they shall be held to be the minimum requirements for the promotion of the health, safety and general welfare. It is not intended to annul other rules, regulations or ordinances provided that where two or more ordinances conflict, the provisions of the ordinance or code imposing the greatest restriction shall control.
The following sections of the BOCA National Plumbing Code, Seventh Edition, 1987, are hereby revised as follows:
A. 
Section P-100.0, General, § P-100.1, Title, is amended by inserting the following paragraph:
P.100.4. For the purposes of this code, the Code Official shall be the Code Enforcement Officer established in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I. The Code Enforcement Officer shall be responsible for the administration and enforcement of this code as set forth in the Code of Ordinances of the Township of Swatara, Chapter 128, Article I, Administration.
B. 
Sections P-101.0 through P-122.0 are hereby deleted in their entirety.
C. 
Section P-104.0, Existing Use, § P-104.1, is amended to read as follows:

Section P-114.0, Fees, § P-114.2, is amended to read as follows:
§ P-114.2 Fee Schedule: The permit fees for all plumbing work shall be fixed from time to time by the Board of Commissioners.

Section P-117.0, Violations, § P-117.4, is amended to read as follows:
P-117.4 Penalties: Any person who shall violate any provision of this code or who fails to comply with any of the requirements thereof, or who shall install, extend, alter, repair or maintain plumbing systems in or adjacent to a building or structure, in violation of a detailed statement or plan submitted and approved thereunder, shall, upon conviction thereof, be sentenced to pay a fine of not less than $30 nor more than $1,000 and costs of prosecution, or in default of payment of such fine and costs, to undergo imprisonment for not more than 30 days. Also the owner of a building or structure or portion thereof, or of or shall exist, and an architect, engineer, builder, contractor, agent, person or corporation employed in connection therewith and who may have assisted in the commission of such violation shall each be guilty of a separate offense, and shall, upon conviction thereof, be sentenced to pay a fine not less than $30 nor more than $1,000 and costs of prosecution, or, in default of payment of such fine and costs, undergo imprisonment for not more than 30 days. Whenever any such person shall have been notified by the Plumbing Official of such violation, by prosecution or in any other manner, each day thereafter that such violation shall continue shall a separate violation hereof and may be punishable as such hereunder.
F. 
Section P-303.0, Connection to Public Water and Sewer System, § P-303.1, is hereby amended to read as follows:
P-303.1 General: The water distribution and drainage system of any building in which plumbing fixtures are installed shall be connected to a public water main and sewer respectively, if available. Where a public water main is not available, an individual water supply shall be provided. Where a public sewer is not available, a private sewage disposal system shall be provided conforming to the Pennsylvania Sewage Facilities Act, Act 537, as amended, approved January 24, 1966, and all amendments and supplements thereto, and the rules and regulations promulgated thereunder, Title 25, Pennsylvania Code.
G. 
Section P-303.0, Connection to Public Water and Sewer System, § P-303.2, is hereby deleted in its entirety.
H. 
Section P-308.0, Protection of Pipes, § P-308.3, is hereby amended to read as follows:
P-308.3 Freezing: Water service piping shall be installed below recorded frost penetration but not less than three feet zero inches below grade. In climates with freezing temperatures, plumbing piping in exterior building walls or areas subjected to freezing temperatures shall be adequately protected against freezing by insulation or heat or both.
