Except as herein provided, no person, partnership, association or corporation shall dump or accumulate or cause to allow to be dumped or accumulated on any land, public or private, within the limits of the Township of Washington, Erie County, Pennsylvania, any rubbish, refuse, garbage or waste material of any sort, nor shall any dumping grounds be allowed or maintained, nor land used for dumping purposes within the limits of said township without first obtaining a permit therefor.
Any person, partnership, association or corporation who desires to establish, permit or maintain a dumping grounds for the accumulation of rubbish, refuse, garbage or waste material of any sort within the limits of the Township of Washington, County of Erie and State of Pennsylvania, shall first make application therefor to the Township Council of said township, which application shall set forth the location and ownership of the land, the type of material to be dumped and the character of the supervision to be furnished; said application shall be signed by the owner of the land upon which it is proposed to establish the dump and by the person or persons who propose to establish and operate said dump.
If, upon application for such permit and after investigation of the premises and circumstances, the Township Council is satisfied of the propriety of the establishment and maintenance of said dump, it shall, after the applicant shall furnish such security as said Township Council may require to abide by all conditions of the permit and to observe all rules and regulations relating to the use of said land and the operation of said dump, issue a permit therefor, which permit shall state on its face the conditions under which said dump shall be maintained and rules and regulations to govern the use of said land and the operation of said dump. Evidence of the granting of the permit, together with the number thereof, shall be prominently displayed at all times upon the land where any dump is maintained.
If any person, partnership, association or corporation shall cause or allow the violation of any conditions under which their permit was issued or the violation of any rule or regulation which governs the use of the land and the operation of such dump, the Township Council may, after 10 days' written notice to said person, partnership, association or corporation, or their sureties, of said violation, cancel their permit, clean up said dump and collect the cost thereof from the owner of the land, the operator of the dump or the surety.
If any person, partnership, association or corporation shall dump any rubbish, refuse, garbage or waste material on any land, public or private, in said Township of Washington in violation of this chapter, the Township Council may, after 10 days' written notice to said person, partnership, association or corporation of said violation, remove said rubbish, refuse, garbage or waste material and collect the cost thereof from said person, partnership, association or corporation.
Any person, partnership, association or corporation who shall dump any rubbish, refuse, garbage or waste material in violation of this chapter, or any person, partnership, association or corporation who shall establish, permit or maintain a dumping grounds for the accumulation of rubbish, refuse, garbage or waste material of any kind without first obtaining a permit therefor, or any person, partnership, association or corporation who shall violate or permit the violation of any permit issued or the rules and regulations which govern the use of the land and the operation of the dump for which a permit was issued, shall, upon summary conviction before a District Justice, be sentenced to pay a fine or penalty of not less than $10 and not more than $300, for the use of the Township of Washington, and cost of suit and, in default of payment thereof, such person, partner, member of an association or officer of any corporation shall be committed to the county jail for a period not exceeding 30 days.
Nothing herein contained shall be construed to prohibit or regulate filling or clearing of any land with soil, gravel or industrial cinders and no permit shall be required therefor.
