A service charge is hereby established to offset,
in whole or in part, the Township's cost of collection and disposal
of trash and garbage from each residential dwelling unit at a rate
established by resolution of the Township Board of Supervisors. Said
service charge or fee shall be imposed on the property owner of record
of any residence building containing one or more dwelling units and
shall be paid in advance per calendar year.
The service charge for the collection and disposal
of trash and garbage shall not apply to commercial and industrial
establishments and/or multifamily dwelling units exceeding three dwelling
units where Township refuse collection and disposal services are not
provided.
All bills for the collection of this service
charge shall be forwarded to affected property owners at such time
and in such manner as directed by the Township Board of Supervisors.
All such service charges for trash collection
shall be filed with the Township's Finance Director who shall give
two months written or printed notice that the service charges are
due and payable, stating the due date for each party charged, either
by service on the owner of property or by mailing such notice to the
owner at his last known post office address.
If the whole amount of the service charge is
paid within two months after the date of the service charge notice,
there shall be a discount of 2% on the amount of service charge due.
A per annum penalty of 10%, which shall become part of the service
charge due and included in the base on which all other delinquent
interest and penalties are calculated, shall be added to the amount
of the service charge not paid within four months after the date of
notice of the service charge. If service charges, or any of them,
remain unpaid at the expiration of the date of the service charge
notice, it shall be placed in the hands of the Township Solicitor
for collection. The Solicitor shall collect the same together with
reasonable attorney's fees, by municipal claim filed against the property
of the delinquent owner in like manner as municipal claims are by
law filed and collected or any other lawful means. When any owner
has two or more lots against which there is a service charge for the
same year, all lots shall be embraced in one claim. All service charges,
when collected, shall be paid over to the Township Finance Director.
The provisions of this article are severable,
and if any portion thereof is held to be invalid, the decision of
the court shall not affect or impair any of the remaining portions
of this article. It is hereby declared to be the intent of the Board
of Supervisors of Whitemarsh Township that this article would have
been adopted if the invalid portion had not been included therein.
Provisions of this article shall become effective
January 1, 1990.
