It shall be unlawful for any minor under the age of 17 to loiter, idle, wander, stroll, or play in or upon the public streets, roads, alleys, sidewalks, or other public grounds, public places and public buildings, places of amusement, entertainment, vacant lots or other unsupervised places of the Borough of New Hope between the hours of 9:00 p.m. and 6:00 a.m. of the following day; subject to the exceptions set forth in § 122-2 hereof. Each violation of the provisions of § 122-1 shall constitute a separate offense.
The provisions of § 122-1 of this chapter shall not apply to a minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate business directed by his or her parent, guardian or other adult person having the care and custody of the minor.
It shall be unlawful for the parents, guardian or other adult person having the care and custody of a minor under the age of 17 years to knowingly permit such minor to loiter, idle, wander, stroll or play in or upon the public streets, roads, alleys, sidewalks, or other public grounds, public places and public buildings, places of amusement, entertainment, vacant lots or other unsupervised places of the Borough of New Hope between the hours of 9:00 p.m. and 6:00 a.m. of the following day; except, however, in situations as set forth in § 122-2 hereof. Each violation of the provisions of this section shall constitute a separate offense.

A. 
Any minor violating the provisions of this chapter shall be, upon conviction thereof, sentenced to pay a fine of not more than $600 and costs of prosecution, and in default of payment of such fine and costs, shall be delivered to the appropriate juvenile authorities.
B. 
Any adult who shall violate any of the provisions of this chapter shall, upon conviction thereof before any District Justice, be sentenced to pay a fine of not more than $600 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days.
