The Board of Trustees hereby finds that it will serve the health, welfare
and safety of the Village and its residents to adopt this chapter in order
to promote the elimination of junked, abandoned, disabled and dangerous motor
vehicles within the Village.
As used in this chapter, the following terms shall have the meanings
indicated:
ABANDONED MOTOR VEHICLE
Any vehicle which is parked or permitted to stand unattended on any
public street or alley for a continuous period exceeding 72 hours and which
does not have a valid registration plate or certificate of inspection and
an ascertainable vehicle identification number.
DANGEROUS MOTOR VEHICLE
Any motor vehicle which is a threat to the health, safety or welfare
of the public for any reason, including:
A.
It is kept in such a condition as to become a haven for rodents, vermin
or other animals;
B.
It has broken glass or other sharp edges; or
C.
It is maintained in a precarious or dangerous position or location.
DISABLED MOTOR VEHICLE
Any motor vehicle which is immovable or inoperable because it lacks
an engine, one or more tires or other essential part or because it has been
stripped or disassembled.
JUNKED MOTOR VEHICLE
Any disabled motor vehicle which has no valid registration plate
or certificate of inspection.
MOTOR VEHICLE
A vehicle which is self-propelled except one which is propelled solely
by human power or by electric power obtained from overhead trolling wires,
but not operated upon rails.
PERSON
Any natural person, firm, company, partnership or corporation, including
their principals and agents.
Any person(s) who parks, stores or causes or permits to stand or to be parked or stored any junked, abandoned, dangerous or disabled motor vehicle in violation of §
204-3 of this chapter shall, upon conviction thereof, be subject to a fine not to exceed $250 or to a term of imprisonment not to exceed 15 days, or both. Each day a violation continues shall constitute a separate violation of this chapter.
