No person or entity shall ignite or maintain an open fire within the corporate limits of the City of Crisfield except pursuant to the provisions of this chapter. Any provision of Chapter 30 of this Code (including but not limited to the Housing Standards incorporated by reference therein), as amended, that is inconsistent with the provisions of this chapter shall be superseded by the provisions of this chapter, it being the intention of the City of Crisfield to provide in this chapter the exclusive means by which an open fire may be ignited or maintained in the City of Crisfield.

Notwithstanding anything in this chapter to the contrary, an individual may burn leaves, boxes, weeds, wood and paper in the City of Crisfield, in a metal trash can or other nonflammable receptacle, between the hours of 1:00 p.m. and 6:00 p.m. on Fridays and the hours of 8:00 a.m. to 12:00 p.m. on Saturdays only. The burning of any material or substance other than leaves, boxes, weeds, wood or paper in the City of Crisfield is strictly prohibited and shall constitute a violation of this chapter pursuant to § 34-3. All burning shall be suspended during burning bans issued by Somerset County Emergency Management Services.
Any person or entity who ignites or maintains an open fire in the City of Crisfield, other than pursuant to § 34-2 above, shall be guilty of a municipal infraction.
The sole purpose of this chapter is to accommodate individuals wishing to maintain attractive, sanitary conditions in their lawns and property through the burning of leaves, boxes, weeds, wood and paper. The City undertakes no inspection responsibilities with regard to open burnings in the City and shall not be obligated by this chapter or otherwise to conduct inspections to determine that burnings are being conducted in accordance with this chapter.
