GENERAL REFERENCES
Fees — See Ch. 45.
No person or persons, firms or corporations shall exhibit, keep, maintain or operate pool or billiard tables within the limits of the City of Crisfield without first obtaining a permit or license therefor from the Mayor and Council of the City of Crisfield, for which permit or license there shall be paid at the time of making application for same a nonrefundable fee of $75. Upon the granting of a permit or license for the operation of pool or billiard tables, an additional fee of $250 for the first table and $50 for each additional table shall be paid, which fee shall be repaid annually upon the renewal of the license or permit. The Mayor and Council of the City of Crisfield shall neither issue nor reissue any permit under this chapter without first holding a public hearing, advertised at least 30 days in advance, in a publication of general circulation in Somerset County, Maryland.
A. 
Anyone applying for a permit to operate pool or billiard tables shall accompany the application with the following documentation:
(1) 
A letter signed by at least 12 persons or entities owning property within 2,000 square feet of the location of the proposed pool or billiard operation, supporting the application; and
(2) 
An affidavit signed by the applicant certifying under oath the following circumstances:
(a) 
The pool or billiard table or tables to be operated shall be maintained at least 25 feet from the front boundary line of the underlying property and at least 1,000 feet from any religious establishment;
(b) 
An on-site manager shall supervise operation of the pool hall or billiard room during the term of the permit. The on-site manager's identity and current contact information shall be provided to the Crisfield Police Department. Any changes to the on-site manager's identity or contact information shall be updated daily to the Crisfield Police Department as needed;
(c) 
The applicant is the fee-simple owner of at least a fifty-one-percent interest in the underlying real property;
(d) 
No more than 40% of the floor space of the building housing the pool or billiard table or tables, computed by square foot, is dedicated to use of the table or tables;
(e) 
The underlying property is in a zoning district with a general commercial zoning classification;
(f) 
The applicant is in compliance with all applicable local, state and federal laws; and
(g) 
The applicant has been a resident of Somerset County for at least two years immediately prior to the submission of the application.
B. 
The applicant shall promptly inform the City of any changes in the information provided in the affidavit, including, without limitation, changes in the identity or contact information of the on-site manager.
C. 
For purposes of determining ownership within the meaning of § 87-2A(2)(c) above, if the underlying premises is owned by a limited-liability company, a corporation or a general partnership, then a member of the limited-liability company, a shareholder of the corporation or a general partner of the partnership shall be considered an owner of the premises in proportion to that person's interest in the entity.
All pool or billiard tables must cease to be operated promptly at 12:00 midnight on each and every night except Sunday. Tables may be operated between the hours of 1:00 p.m. and 10:00 p.m. on Sunday.
As used in this section, the following terms shall have the meanings indicated:
A. 
Definitions.
ESTABLISHMENT
A single physical location where business is conducted or where services are performed, and, in the case of a building consisting of multiple stories in which a different business occupies a floor of the building, "establishment" shall mean that floor of the building on which the business is located. The possession of a distinct trader's license issued by the Clerk of the Court for Somerset County shall be conclusive proof that a business is its own "establishment" for purposes of this section.
INDOOR AREA
All space in a structure or building with a ceiling that is enclosed on all sides by any combination of permanent or temporary walls, windows, or doorways, whether open or closed, or other physical barriers extending from floor to ceiling.
B. 
Prohibition of persons under 21. No establishment at which a pool table or tables licensed under this chapter are maintained or operated shall permit or allow any person under 21 years of age to be present in an indoor area of the establishment. All pool tables licensed under this chapter must be maintained or operated in an indoor area of the establishment.
C. 
Required sign. It shall be the duty of the holder of said permit or license to post conspicuously in the establishment the following sign: "Persons under 21 years of age are not allowed here."
All such permits or licenses shall expire on the first day of May, annually, following their issuance. A permit shall reissue only upon a reapplication providing all the information and documentation required by § 87-2, complying with the formalities specified by § 87-1, and accompanied by the fees provided in § 87-1.
A violation of § 87-2, above, shall be declared to be an infraction. The penalty for violation shall be $100 for each initial offense and $500 for each repeat offense.
Upon presentation of evidence to the Mayor and Council of the City of Crisfield of a violation of § 87-2, 87-3 or 87-4 of this chapter, the Mayor and Council of the City of Crisfield may revoke the license of any person or persons, firm or corporation maintaining or operating pool or billiard tables in violation thereof.
All licenses shall be issued to specific applicants and for specific locations and shall not be transferable among applicants or between locations.
