The Board of Trustees finds that, due to the relatively small population of the Village of Irvington, it is not always possible to fill certain positions in Village government requiring municipal, administrative or financial expertise with Village residents who are duly qualified to hold such positions. The Board further finds that it is authorized under § 10 of the Municipal Home Rule Law and § 3-300 of the Village Law to expand such residency requirements to allow residents of the Ninth Judicial District of New York or of New York State to be eligible for said positions and that such eligibility is appropriate when a qualified person who is a Village resident is unavailable.
Notwithstanding any other general or special law, a person shall be eligible to be appointed to or hold the nonjundicial position of Village Court Clerk, Assistant Court Clerk or Court Attendant, provided such person is a resident of the Village or a resident of the Ninth Judicial District of New York at the time of appointment.

Notwithstanding any other law, a person shall be eligible to be appointed to the position of Village Clerk, Village Treasurer, Building Inspector or Assistant Building Inspector if such person is a resident of New York State.
This article shall take effect immediately upon filing with the Secretary of the State of New York and shall apply to all persons currently holding the positions of Village Court Clerk, Assistant Court Clerk or Court Attendant or Village Clerk, Village Treasurer, Building Inspector or Assistant Building Inspector as well as any person hereafter appointed to fill such offices.

Pursuant to Municipal Home Rule Law § 10.1(ii)(a)(1), this chapter shall supersede the residency restrictions contained in Village Law § 3-300 and Public Officers Law §§ 3 and 30.
