Be it resolved, by the Board of Supervisors of East Brandywine Township, that in addition to the powers provided by the Second Class Township Code,[1] 42 Pa.C.S.A. § 6324(3), and other statutes of the Commonwealth of Pennsylvania, police officers of this Township shall, upon view, have the right to arrest without warrant upon probable cause when there is ongoing conduct which could reasonably be expected to endanger the health, safety and welfare of any person, including the proposed arrestee, or could reasonably be expected to cause damage to public or private property in the case of the following offenses: disorderly conduct (18 Pa.C.S.A. § 5503); public drunkenness (18 Pa.C.S.A. § 5505); obstructing highways and other public passages (18 Pa.C.S.A. § 5507); and purchase, consumption, possession or transportation of intoxicating beverages by a person under the age of 21 (18 Pa.C.S.A. § 6308).

Notwithstanding the foregoing, for any person who shall have been arrested without a warrant as provided for hereinabove, the police officer shall comply with the requirements of Pennsylvania Rules of Criminal Procedure 441.
