From and after the effective date of this chapter, the owners and the agents and managers of such owners who own premises situate in East Brandywine Township, which premises are occupied by persons who are not members of the immediate family of such owners; shall make a written report to the Township as set forth more particularly in § 202-2 hereinafter. For the purposes of the provisions of this chapter, "immediate family" shall mean parent, grandparent, child or grandchild of the owner.
The report required by this chapter shall provide the following information about the persons specified in § 202-1: name, residence, whether under or over the age of 18 years, and if under the age of 18 years, the age at the time of the filing of the report. Such information shall be provided to the Township Secretary within one month from the effective date of this chapter. The information on such reports shall be supplemented or amended within 15 days after the arrival or departure of the occupants of the subject premises.
Failure to comply with the provisions of §§ 202-1 and 202-2 of this chapter by the owner or the owner's agent or manager shall constitute a violation of this chapter. Violations shall be prosecuted by a summary proceeding brought before a Magisterial District Judge having jurisdiction, and upon conviction before said Magisterial District Judge, the person shall be liable for the payment of a penalty of not less than $10 nor more than $600, together with the cost of prosecution for each and every offense hereunder and in default of payment of such fine and costs, imprisonment as may be provided by law.
