As used in this chapter, the following terms shall have the meanings indicated:
SETBACK
The distance between the street line and the nearest part of any building on the lot, excluding cornices, eaves and gutters projecting not more than 30 inches.
STREET LINE
The line defining the legal width of a street or a proposed street on which a lot abuts.
The setback of any building to be erected, altered or repaired on the west side of Church Lane between Myra Avenue and Baily Road shall be not less than eight feet from the street line.
The setback of any building to be erected, altered or repaired on the east side of Church Lane between Myra Avenue and Baily Road shall be not less than three feet from the street line.
The setback of any building to be erected, altered or repaired on the east and west sides of Church Lane between Gunther and Whitby Avenues shall be not less than 10 feet from the street line.
The setback of any building to be erected, altered or repaired on the south side of Chester Avenue between Church Lane on the east and the Borough line on the west, and on the north side of Chester Avenue from a point approximately 100 feet east of Church Lane to the Borough line on the west, shall be not less than three feet from the street line.
The setback of any building to be erected, altered or repaired and situated not more than 100 feet north or south from the north or south side of Chester Avenue and on the east or west side of any street appearing on the official Borough Plan, whether opened or unopened, joining with or intersecting the south side of Chester Avenue between Church Lane and the Borough line, and on the north side of Chester Avenue from a point approximately 100 feet east of Church Lane and the Borough line, shall be not less than 25 feet from the street line.
The setback of any building to be erected, altered or repaired on the east or west side of Church Lane between Penn Street and Myra Avenue shall be not less than three feet from the street line.
The setback of any building to be erected, altered or repaired on the east side of Wycombe Avenue between Providence Road and a point 80 feet (more or less) southwardly from the southerly side of Providence Road shall be not less than five feet from the street line.
The setback of any building to be erected, altered or repaired on the east side of Cedar Avenue between the south side of MacDade Boulevard and the Borough line shall be not less than five feet from the street line.
The setback of any building to be erected, altered or repaired on the south side of MacDade Boulevard between the east side of Cedar Avenue and a point 250 feet east of the easterly side of Cedar Avenue shall be not less than five feet from the street line.
In the case of a corner lot and in cases where setbacks have not yet been fixed for the side street, the setback from the side street line shall be the same as the setback required from the front street line. In cases where setbacks have been established by this chapter or by any other ordinance not inconsistent herewith, the setback shall be as therein established.
A. 
Whoever violates or fails to comply with any of the provisions of this chapter shall be fined not less than $100 nor more than $1,000 or imprisoned not more than 10 days in the Borough lockup or not more than 30 days in the county jail or workhouse, or both such fine and imprisonment. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
B. 
The application of the penalty provided for in Subsection A hereof shall not prevent the enforced removal of prohibited conditions.
