It is hereby declared to be the policy of the City of Canandaigua that the health and safety of the citizens of said City require that the City be prepared to act quickly and responsibly to minimize the risks to both citizens and their property which may result from greatly reduced water supply, regardless of cause.
Whenever it shall appear that the availability of water supply to residents of the City is or may be jeopardized as the result of adverse weather, equipment or system failure, or for any other reason, the City Manager shall fully investigate the availability of water to meet potential emergency needs. If he shall determine that such actions are warranted by water availability, he shall take the following steps:
A. 
If the City Manager shall determine that required water levels can be maintained or restored by voluntary reductions in water usage, he shall cause to be published a list of prohibited uses such as, but not limited to, watering lawns, washing cars, filling swimming pools, etc. Citizens will be asked to comply voluntarily with such restrictions.
B. 
If, after implementing Subsection A above the City Manager shall determine that additional effort is required to assure voluntary reductions in water usage, and provided he shall determine that such additional effort may effectively maintain or restore water availability, he shall cause City employees to deliver notices to individuals not complying with the list of prohibited uses, said notices to explain the need for water conservation and to reiterate specifically the request for voluntary compliance.
C. 
If at any time, and regardless whether steps described in Subsections A and B above have been undertaken, the City Manager shall determine that the availability of water is or may be so reduced as to create a dangerously unacceptable risk of danger to residents and their property, he shall report such determination to the City Council.
The City Council may, following report by the City Manager or on its own motion, determine that actual or potential water shortages are of a degree causing unacceptable risk and that, therefore, a water emergency exists. Such a determination shall be made by resolution of the Council which must be passed by at least a simple majority of members present and voting upon the resolution shall remain in effect until rescinded by the same procedure.
Following the declaration of a water emergency by passage of a resolution to that effect, the City Manager shall cause to be published a list of prohibited uses of water and a notice that violations of any restriction shall be prosecuted under this chapter.
Any person who shall use, or suffer or permit use of, water from the City of Canandaigua public water supply system in violation of published restrictions upon water usage following a declaration of water emergency shall, upon conviction, be punishable by a fine not exceeding $250 or imprisonment in the County Jail of Ontario County for not more than 15 days, or both such fine and imprisonment Each day on which such violation continues shall constitute a separate offense.
