As used in this article, the following terms shall have the
meanings indicated:
Those spaces which are reserved for handicapped persons who
have been issued identification cards, windshield placards or wheelchair
symbol license plates. The spaces shall be marked by signs that said
spaces have been reserved for use by handicapped persons, which signs
shall be in conformance with the Manual on Uniform Traffic Control
Devices for Streets and Highways.
Any person who has lost the use of one or more limbs as a
consequence of paralysis, amputation or other permanent disability
or who is permanently disabled as to be unable to ambulate without
the aid of an assisting device or whose mobility is otherwise limited
as certified by a physician with a plenary license to practice medicine
and surgery in the State of New Jersey or a state bordering the State
of New Jersey.
No person shall park, stop or stand a motor vehicle at any time
in a handicapped parking space at a public building or area unless
such person is a handicapped person or is driving such handicapped
person for the handicapped person's benefit to a public building or
area.
The terms and provisions of this article shall be enforced by
the Toms River Township Police Department, Code Enforcement Officer,
Toms River Township Parking Authority and such other persons as the
Township may designate to enforce this article by resolution.

The locations described in Schedule XXIV, attached to and made a
part of this chapter, are hereby designated handicapped parking spaces.

The locations described in Schedule XXVII, attached to and made a
part of this chapter, are hereby designated handicapped parking spaces.
D.Â
The locations which are properly marked and signed to identify them
as handicapped parking spaces in all areas where federal or state
law or regulations require parking to be set aside for the handicapped
are hereby designated handicapped parking spaces.

The locations which are identified as handicapped parking spaces
on all site plans which are approved by the Toms River Township Planning
Board and the Toms River Township Board of Adjustment are hereby designated
as handicapped parking spaces, provided that they are properly designated
through marking and signs as handicapped parking spaces.
Any person convicted of a violation of a provision of Article XVIII, Handicapped Parking, of this Part 1 shall be liable to a penalty of not less than $250, and for a second or subsequent offense shall be liable for a penalty of not less than $250 and imposition of up to 90 days' community service, or both.
