The Board of Supervisors of the Township hereby
create the office of Township Manager with the Township of Maidencreek,
Berks County, Pennsylvania.
The Township Manager shall have not less than
five years' experience in government and/or business administration
and shall have such other education and experience as the Board of
Supervisors shall determine from time to time. The Township Manager
may but need not be a resident of the Township.
The Township Manager shall be appointed for
an indefinite term by majority vote of the Board. The Township Manager
serves at the pleasure of the Board of Supervisors and may be removed
at any time by majority vote of the Supervisors with or without cause.
Before the Township Manager begins service,
the Township Manager shall give bond to the Township and surety to
be approved by the Board in an amount of not less than $800,000. Said
bond is to be conditioned upon the faithful performance of the Township
Manager's duties and responsibilities. The premium for said bond shall
be paid by the Township.
The salary of the Township Manager, the Township
Manager's benefits and emoluments of employment shall be fixed from
time to time by resolution of the Board of Supervisors.
Subject to recall as provided in Section 1301(b)
of the Second Class Township Code, the Township Manager shall be the chief administrative
officer of the Township and shall be responsible to the Board of Supervisors
as a whole for the proper and efficient administration of the affairs
of the Township. The powers and duties of the Township Manager shall
be nonlegislative and shall relate to general management of all Township
affairs not expressly conferred upon other Township officials or employees
by statute, ordinance, collective bargaining agreement or otherwise.
Specifically, the Township Manager shall:
A. Supervise and be responsible for the activities of
all Township departments;
B. Supervise and be responsible for the activities of
all Township employees;
C. Recommend to the Board of Supervisors the hiring of
employees and discipline any employee, subject to all Township requirements
pursuant to collective bargaining agreements, and subject to approval
and/or reversal by the Board at its next meeting;
D. Hold such other Township offices or employment, or
head one or more departments as the Board may from time to time specifically
direct, by resolution;
E. Attend all meetings of the Board of Supervisors and
such other meetings of Township Officials as the Board of Supervisors
shall direct and keep the Board of Supervisors timely informed as
to all the affairs of the Township and make such recommendations to
the Board as may be necessary and/or expedient to further the health,
safety and welfare of the Township and its residents;
F. Shall serve as and perform the duties and exercise
the powers of Township Secretary and/or Assistant Secretary, as determined
by the Board;
G. Serve as and perform the duties of Township Treasurer
and/or Assistant Treasurer, as determined by the Board;
H. Consistent with directives from and policies established
by the Board from time to time, investigate, dispose of all complaints
regarding Township services and personnel and report the same to the
Board of Supervisors.
I. Prepare and submit to the Board before October 15
of each year, or at any alternate date established by the Board, a
balanced budget for the next fiscal year and an explanatory budget
message which shall provide and narrative explanation for the fiscal
plan, emphasizing significant changes in revenues and/or expenditures,
specific programs or projects and in general providing such information
as the Board shall determine;
J. Be responsible for the administration of the Township's
budget after its adoption by the Board;
K. Develop, in conjunction with the preparation of the
annual budget, a long-range fiscal plan for the Township;
L. Promptly keep the Board and individual Board members
fully informed as to the conduct of all Township affairs, except where
the Board, and existing statute and/or ordinance requires or provides
otherwise, enforce the laws of the Commonwealth of Pennsylvania and
the ordinances and resolutions of the Township;
M. Make recommendations to the Board and assist in the
preparation and negotiation of all agreements, contracts, and other
obligations by and with the Township, as requested;
N. See that the provisions of all leases, permits, franchises,
and other contractual obligations granted by the Township are observed;
O. Serve as primary purchasing officer of the Township
and provide for the acquisition of all supplies, equipment, and other
requirements subject to the requirements of the laws of the commonwealth,
including but not limited to the Second Class Township Code;
P. Be responsible for accounts payable and receivable
and shall see to it that Township obligations are promptly fulfilled
and Township claims promptly pursued;
Q. Provide such other reports and information as requested
from time to time by the Board;
R. Diligently work to establish and enhance cooperation,
communication, and coordination among all Township departments and
personnel in the discharge of functions and duties on behalf of the
Township;
S. Promptly advise the Board on all matters coming to
the attention of the Manager's attention relating to the Township;
and
T. In general, perform all administrative duties and
obligations and see to the performance of the same by and on behalf
of the Township.
In the event the Township Manager becomes ill,
disabled, or unavailable, the Board of Supervisors shall have the
power to appoint an interim manager, or to perform the duties of Township
Manager as a Board as provided by law.
