[HISTORY: Adopted by the Board of Supervisors
of the Township of Maidencreek 2-10-2005 by Ord. No. 198. Amendments noted where
applicable.]
It is against public policy to permit uncontrolled
and unrestricted placement and parking of recreational and commercial
vehicles upon any Township-designated roadway within Maidencreek Township.
The purpose of this chapter is to prevent needless disregard of potential
damage to life and property because of the presence of recreational
and commercial vehicles parked upon the same.
For the purposes of this chapter, the following
words and terms shall have the meanings ascribed to them herein:
Any motor vehicle having a commercial license and/or any
vehicle which requires as a prerequisite to operation the acquisition
of a Pennsylvania Commercial Driver's License, including, but not
limited to, tractor trailers and/or truck tractors, straight body
trucks, flat-bed trucks, storage trucks, refrigerator trucks, tri-axles,
and/or any other vehicle in excess of 10,000 pounds. For purposes
of this chapter, the term "commercial vehicle" excludes police, fire,
or emergency vehicles, Township vehicles, and any motor vehicle in
the continuous process of making deliveries to or picking up property
from a property on the highway or street.
The Northern Berks Regional Police Department shall be designed
as the enforcement agency under this chapter.
The Maidencreek Township Board of Supervisors.
The entire width between the boundary lines of every way
publicly maintained by Maidencreek Township and designed as a Maidencreek
Township road, where any part thereof is open to the use of the public
for purposes of vehicular travel.
Any individual, partnership, organization, association, agency,
firm, estate, or corporation and any and all other legal or commercial
entities.
That portion of land not in the public domain nor publicly
maintained Maidencreek Township roadway.
A vehicle designed, or adapted, or used for recreational
purposes. For purposes of this chapter, this definition includes but
is not necessarily limited to trailers, campers, motor homes, house
trailers, trailers containing boats, snowmobiles and/or any other
specialty vehicle, camping trailers, truck campers, utility trailers
when attached to another vehicle, etc.
That portion of a Maidencreek Township roadway less the roadway
and any shoulder.
That portion of a Maidencreek Township street, designated
or ordinarily used for vehicular travel and/or parking. If a highway
includes two or more separate roadways, the term "roadway" refers
to any such roadway separately, but not to all such roadways collectively.
That portion of a highway on either side of the roadway that
is normally snowplowed for the safety and convenience of vehicular
traffic.
A.Â
Compliance with chapter. Within the Township of Maidencreek,
it shall be unlawful to permit or cause the parking, storing or placement
of any commercial vehicle and recreational vehicle upon any and all
Maidencreek Township public street, roadway and/or shoulder whatsoever,
of whatever nature, without complying with this chapter.
B.Â
Exception. Notwithstanding the foregoing, a resident
may place a camper, trailer, and/or boat and park the same on the
public roadway for purposes of loading and/or unloading in preparation
for use of said recreational vehicle if the resident complies with
all of the following:
(1)Â
The camper, trailer, and/or boat is and remains physically
attached to the vehicle towing the same;
(2)Â
The recreational vehicle at issue is placed so as
not to block visibility for neighboring properties or impede ingress
and egress in public streets; and
(3)Â
Does not remain on the public roadway for this purpose
for more than 48 hours.
