Pursuant to applicable federal law, including 25 U.S.C.A. § 1302 and 18 U.S.C. § 1161, which requires that tribal regulation of liquor on Indian reservations be in conformity with the laws of the state in which the reservation is located, the Menominee Indian Tribe, acting through its governing body, the Menominee Tribal Legislature, hereby incorporates into Menominee law Ch. 125, Wis. Stats., as amended from time to time, substituting where necessary the Tribe and is agents and agencies for the state and its agents, agencies or subdivisions.
A. 
Repeal of prior amendments. The amendments to Ordinance No. 79-31 adopted on September 29, 1988, and June 12, 1993, are repealed, and § 125.07, Wis. Stats., which is incorporated pursuant to this article as part of Ch. 125, Wis. Stats., is reinstated in its entirety except for the changes noted in this section.
B. 
Amendments to § 125.07, Wis. Stats.
(1) 
Section 125.07(1)(a)1 is amended to delete the phrase "not accompanied by his or her parent, guardian or spouse who has attained the legal drinking age."
(2) 
Section 125.07(1)(a)2 is amended to delete the phrase "not accompanied by his or her parent, guardian or spouse who has attained the legal drinking age."
(3) 
Section 125.07(3)(a) is amended to delete the phrase "not accompanied by his or her parent, guardian or spouse who has attained the legal drinking age."
(4) 
Section 125.07(4)(a)2 is amended to delete the phrase "unless accompanied by a parent, guardian or spouse who has attained the legal drinking age."
(5) 
Section 125.07(4)(b) is amended to delete the phrase "not accompanied by his or her parent, guardian or spouse who has attained the legal drinking age."
C. 
Penalties.
(1) 
Any person convicted of providing intoxicants to persons under 21 years of age shall be assessed a fine not to exceed $1,000 or imprisoned not to exceed one year, or both.
(2) 
Any penalty contained in Chapter 125 of the Wisconsin Statutes adopted by this article which exceeds one year of imprisonment or $5,000 is replaced with a penalty of one year of imprisonment or fine of $5,000, or both.
