The Bureau of Fire Prevention in the City of
Linwood established April 26, 1967, shall enforce the Uniform Fire
Code State of New Jersey. The Bureau shall consist of a certified
Fire Official and certified fire inspectors. The Bureau shall work
with the Linwood Building Department while enforcing the code. The
Linwood Volunteer Fire Company Chief shall recommend to the Common
Council of the City of Linwood, New Jersey, the person to be the appointed
Fire Official. Said Fire Official shall be in control of the Bureau
of Fire Prevention and shall serve only upon approval of the Common
Council of the City of Linwood, New Jersey.
It shall be unlawful for any person to violate
this chapter, to permit or maintain such violation, to refuse to obey
any provision thereof or to fail or refuse to comply with any such
provisions or regulations except as variation may be allowed by action
of the Linwood Bureau of Fire Prevention in writing. Proof of such
unlawful act or failure to act shall be deemed prima facie evidence
that such act is that of the owner. Prosecution or lack thereof of
either the owner or the occupant shall not be deemed to relieve the
other.
The provisions shall apply equally to both public
and private property. It shall apply to all new structures, equipment,
etc., and except as otherwise specified, to existing structures and
their occupancies.
This act shall be in accordance with the laws
and regulations of the New Jersey State Uniform Fire Safety Act (N.J.S.A.
52:27D-192 et seq.).
This act shall be deemed an exercise of police
powers of the City of Linwood for the preservation and protection
of the public health, peace, safety and welfare, and all its provisions
shall be liberally construed for that purpose.
The provisions of this act shall be administered
by the Linwood Bureau of Fire Prevention of the City of Linwood.
Unless specifically provided for in other codes
or ordinances of the City of Linwood, the New Jersey State Uniform
Fire Code and the National Fire Protection Codes of 1967-68, as published
by the State of New Jersey and the National Fire Protection Association,
and any and all supplements, deletions, modifications and amendments
thereto, shall apply. Said codes are hereby incorporated in this act
by reference, with copies of said codes being on file with the City
Clerk and the Bureau of Fire Prevention.

Any person, firm or corporation who shall violate the provisions
of this chapter shall be subject to a fine or penalty as outlined
in N.J.A.C. 5:70-2.12 of the New Jersey Uniform Fire Code.
