The Linwood Board of Recreation, hereinafter
“Rec Board,” is recognized as an existing Board of the
City of Linwood. The Rec Board is hereby authorized and empowered
to act for the betterment of the City of Linwood as expressly provided
herein. To the extent necessary, prior acts of the Rec Board consistent
with its described authority are hereby ratified.
The Rec Board shall consist of five to seven
Linwood resident members, each of which shall be appointed by the
Mayor. Board members shall serve without compensation. Terms on the
Board shall be for five years, to be established in such a manner
that the term of at least one member and not more than two members
shall expire in each year.
The Rec Board is hereby granted all reasonably
necessary powers and responsibilities and is authorized to act to
fulfill the following purposes:
A. To improve, maintain, manage, control, regulate and
otherwise operate and supervise public parks, playgrounds and athletic
fields in the City of Linwood, subject to the advice and consent of
Council, pursuant to N.J.S.A. 40:12-1 et seq. and N.J.S.A. 40:61-1
et seq. The power to acquire, exchange or sell property is specifically
reserved to Council;
B. To create, promote, coordinate and run community and
recreational events for the benefit and enjoyment of residents of
Linwood, including but not limited to the Memorial Day Parade ceremony/celebration
and Essay Contest, Fall Festival/Halloween Event, the Easter Egg Hunt/Passover
Event, Citizen of the Year and the Hanukkah/Christmas Tree Lighting;
and

C. To act as the designee of Linwood City Council for
oversight of Linwood sports organizations, subject to the advice and
consent of Council, and in so doing promote recreation, good sportsmanship
and citizenship of participant children and adults, limited to the
following specific areas of authority:
(1) To consider, approve and endorse applications by nonprofit
sports organizations for use of Linwood fields and facilities, including
making decisions on competing applications;
(2) To establish reasonable rules and procedures to effectuate
the providing of uniform and reasonable commonly accepted procedures
by and of Linwood sports organizations, together with the providing
of reasonable public availability and disclosure of certain documents
in an acceptable form, specifically copies of bylaws, rules and regulations,
written membership and voting qualification procedures, proof of the
existence of a grievance procedure, annual financial statements and
budgets, minutes of organizational meetings and proof of liability
insurance; and
(3) To hear appeals of grievances from individual sports
organizations on issues of general public importance where the grievance
has first been properly submitted to the individual sports organization.
Authority shall remain with the individual organizations.

The Rec Board shall have authority over such
public parks, playgrounds and athletic fields as are now or hereinafter
designated by Council, specifically including the grounds and facilities
at Memorial Field, Poplar Avenue Field, and the South Jersey Industries
Park. The Rec Board shall also act as the designee of Council for
issues of maintenance or operation which may arise for grounds or
fields owned by the Linwood Board of Education, specifically including
but not limited to the soccer and baseball fields located at Seaview
Avenue School.
The Rec Board shall be provided such funding
as Council deems necessary to carry out the functions designed herein.
