This article shall be titled "Limitation of Liability for Prescription of Contraceptives to Minors."
As used in this article, the following terms shall have the meanings indicated:
CONTRACEPTIVE
Any drug, medicine, mixture, preparation, instrument, article or device of any nature used or intended or represented to be used to prevent a pregnancy. Contraceptives include but are not limited to all foams, barriers, spermacides and hormonal methods. The hormonal methods include but are not limited to oral contraceptives, injectables (e.g., Depo-Provera®), and implantables (e.g., Norplant®).
A physician with privileges to practice at the Menominee Tribal Clinic or other licensed physicians may examine, insert, counsel and prescribe contraceptives to minor children without the consent of the minor's parents or guardian.
A physician shall not incur any civil or criminal liability for prescribing contraceptives, inserting contraceptives or performing minor surgery in the case of a contraceptive placed under the skin (e.g., Norplant®) for reason of lack of consent of the minor's parents or guardian. In the case of a contraceptive placed under the skin (e.g., Norplant®), this limitation of liability shall only apply to children 16 years of age or older.
