[HISTORY: Adopted by the Borough Council of the Borough of Summit Hill 7-1-1974 by Ord. No. 5-1974. Amendments noted where applicable.]
This chapter is hereby adopted in accordance with 8 Pa.C.S.A. § 1202 for the purpose of properly managing, caring and controlling the Borough and its finances.
No person or persons, partnership, firm or corporation shall move, or cause to be moved, from any place within the Borough of Summit Hill to another place therein or to a place beyond the limits thereof, or move or cause to be moved from any place beyond the limits of the Borough of Summit Hill to a place or places within the Borough of Summit Hill any household goods in bulk, without first securing from the Borough Secretary a permit for such moving or transportation.
Any person or persons, partnership, firm or corporation desiring such a permit for the removal or transportation of household goods in the manner described above shall make application to the Borough Secretary of the Borough of Summit Hill setting forth his, her, its or their name and address and also setting forth names of the owners or reputed owners of the property to be moved, the address and location from which the property is to be moved, and the new address or location of the place to which the property is to be moved.

The Borough Secretary of the Borough of Summit Hill, or any police officer, upon application being made as provided, shall issue a moving permit as required. Such application shall set forth the name of the permit holder as well as the name or names of the owners of the goods to be moved and the address from which the goods are to be moved and the address to which the goods are to be delivered. No permit shall be issued to remove household goods to a place beyond the limits of the Borough when any taxes due the Borough, other than real estate taxes, remain unpaid by the owners of the goods to be moved, nor shall a permit be issued to move household goods to a place beyond the limits of the Borough without the applicant paying a fee as set by resolution of the Borough Council. No fee shall be required to accompany the permit application should household goods only be moving from a place within the Borough to another place within the Borough.

The provisions of this chapter or any other ordinances referenced herein shall be enforced by any police officer of the Borough of Summit Hill.

Any person or persons, partnership, firm or corporation, whether principal or agent, violating any provisions of this chapter, or furnishing false information to the Borough Secretary or using any false name or address shall, upon conviction in a summary proceeding under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. Upon judgment against any person by summary conviction, or by proceedings by summons on default of the payment of the fine or penalty imposed and the costs, the defendant may be sentenced and committed to the Borough correctional facility for a period not exceeding 10 days or to the county correctional facility for a period not exceeding 30 days. Each day that such violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Carbon County.
