The legislature of the State of New York has granted to municipalities, in Article 9-A of the General Municipal Law, a local option for the conduct of games of chance by certain organizations under stated statutory terms and conditions. Pursuant to the terms of this chapter, the conduct of games of chance by bona fide and qualified organizations shall be lawful within the Village of Horseheads as of the effective date of this chapter.
Local Law No. 1-1988 of the Town of Horseheads[2] authorizes the conduct of games of chance, pursuant to Article 9-A of the General Municipal Law of the State of New York, within the Town of Horseheads, which fully embraces and encompasses the territorial limits of the Village of Horseheads. Pursuant to § 187 of the General Municipal Law, the proper officials of the Town of Horseheads shall be and they hereby are authorized and empowered to issue licenses for the conduct of games of chance within the territorial limits of the Village of Horseheads pursuant to and in accordance with said town local law, as currently adopted and amended from time to time.
