All persons desiring to undertake any new construction,
structural alteration or changes in the use of a building or lot shall
apply to the Code Enforcement Officer for a building permit by filling
out the appropriate application form and by submitting the required
fee. The Code Enforcement Officer will then either issue or refuse
the building permit or refer the application to the Zoning Board of
Appeals. After the building permit has been received by the applicant,
he or she may proceed to undertake the action permitted in the building
permit and, upon completion of such action, shall apply to the Code
Enforcement Officer for a certificate of occupancy. If the Code Enforcement
Officer finds that the action of the applicant has been taken in accordance
with the building permit, he or she will then issue a certificate
of occupancy allowing the premises to be occupied.
Under the terms of this chapter, the following
classes of building permits may be issued:
A. Permitted use. A building permit for a permitted use
may be issued by the Code Enforcement Officer on his or her own authority.
B. Special uses. A building permit for a special use
may be issued by the Code Enforcement Officer after Planning Board
review and approval by the Village Board of Trustees.
C. Building permit after an appeal or a request for a
variance. A building permit may be issued by the Code Enforcement
Officer upon the order of the Zoning Board of Appeals and after a
public hearing held by the Zoning Board of Appeals for the purpose
of deciding upon the appeal or a request for variance.
This chapter shall be enforced by the Code Enforcement
Officer, who shall report to the Village Manager. No building permit
or certificate of occupancy shall be issued by him or her except where
all of the provisions of this chapter have been complied with.
The Planning Board shall review applications
and appeals.
A. Referral from Boards. The Board of Trustees shall
refer to the Planning Board all applications for special uses, and
the Zoning Board of Appeals shall so refer to the Planning Board any
other applications or appeals which, in its opinion, require review
by the Planning Board.
B. Criteria for review. The Planning Board shall review
such applications in accordance with applicable criteria set forth
in this chapter.
C. Report to referring Board. The Planning Board may
recommend approval, disapproval or approval subject to conditions
or modifications and shall report its findings to the referring Board
within 30 days of receipt thereof. Such report shall state all recommended
conditions and modifications and the reasons for such recommendation
regarding approval or disapproval.
