A. 
As used in this article, the following terms shall have the meanings indicated:
SIDEWALK
Any improved pavement or part thereof fronting on a street and located within the curbline and building (property) line of said street, and shall also mean any unimproved or ground surface area or part thereof fronting on a street and located within the curbline and the building (property) line of said street if such area is used or usable as a walkway by the general public.

The singular herein shall also include the plural.
The owner, occupant or tenant of every property fronting upon or alongside any streets of the Borough of Birdsboro is hereby required to remove or cause to be removed all snow and/or ice from all sidewalks in front of and/or alongside such property, for a minimum width of three feet measured from the curbline toward the building (property) line if there is no grass plot separating the curb from an improved pavement, or for a minimum width of three feet measured from the line of the improved pavement located along the grass plot toward the building (property) line if there is a grass plot separating the curb from an improved pavement, but in no case exceeding the width of the sidewalk. All such removal shall be completed within 24 hours after said snow and/or ice shall have ceased to fall or be formed on such sidewalks, unless said snow and/or ice be of such a hardened or frozen condition that it cannot be removed without injury to the sidewalk, in which case the owner, occupant or tenant of each such property is required to place salt, sand or other abrasive or chemical material upon said snow and/or ice within the time above provided in order to remedy the aforesaid condition. The owner of said property shall be responsible for conforming to the requirements of this article, whether or not such owner is present on the property, and whether or not such owner has delegated such responsibility to a third party or a tenant. In the instance of a building which is occupied by multiple residential or commercial tenants, any such snow and/or ice removal shall be the responsibility of the owner of said premises, whether or not such responsibilities have been delegated to a third party.
In any case where the owner, occupant or tenant as aforesaid shall fail, neglect or refuse to comply with any of the provisions of any of the sections of this article within the time limits prescribed therein, Borough authorities may proceed immediately to clear the snow and/or ice from the sidewalk of such delinquent owner, occupant or tenant, or to place salt, sand or other abrasive or chemical materials upon the snow and/or ice on the sidewalk in order to rectify a dangerous condition and to collect the expenses thereof with any additional amount allowed by law from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed herein.
Any owner, occupant or tenant who shall fail to remove any snow and/or ice from any sidewalk, or to place salt, sand or other abrasive or chemical materials upon such snow and/or ice on any sidewalk, as required by the terms and conditions of this article shall, upon conviction of such violation before a Magisterial District Judge, be sentenced to pay a fine of not more than $600 and costs, or in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. The minimum fine for any violation of this article shall be $50 plus all costs attributable to the filing of such violation and any additional expenses as imposed herein for maintaining the aforesaid property by the Borough. Each successive 24 hours of failure to remove said snow and/or ice or to place salt, sand or any abrasive or chemical materials upon such snow and/or ice shall constitute a separate offense punishable by like fine or penalty.
Any owner, occupant, tenant, or anyone acting on their behalf, or anyone who removes snow and/or ice from any sidewalk, yard, parking area, or from any other place within the Borough of Birdsboro shall not place such snow and/or ice on any public thoroughfare. Anyone violating the terms of this article shall be subject to the fines and penalties of this article as set forth in § 331-18 herein.
