No person shall be permitted within a city park
or recreation area under the influence of intoxicating beverages,
drugs or narcotics. No person shall possess or consume alcoholic beverages,
drugs or narcotics in any city park or recreation area without the
express permission of the Council or its designated representative.
No person shall build, light or maintain a fire
within a city park or recreation area, except in a camp stove or a
fireplace provided, maintained, or designated for such purpose by
the Council or its designated representative; except, however, that
oil or gasoline camp stoves may be used in established camp sites
or picnic areas where other stoves are provided.
No person shall discharge or set off within
a city park or recreation area any fireworks, except with the approval
of the Council or its designated representative.
No person shall discharge any weapon or firearms
or shoot a bow and arrow within or into a city park or recreation
area.
No person shall molest, trap, capture, hold,
remove, injure or kill any animal or disturb its habitat within a
city park or recreation area.

A. No person shall remain within a city park or recreation
area who does not abide by conditions adopted and posted by the city
for the preservation of good order and the protection of property
within a city park or recreation area; and no person shall remain
within a city park or recreation area who does not abide by the instructions
and directions of duly authorized officers or agents of the Mayor
and Common Council in the lawful performance of their duties. Any
person directed by an agent or officer of the City of Salem to leave
a city park or recreation area shall do so promptly and peaceably.
B. No person shall interfere with or in any manner hinder
any agent or officer of the city while engaged in constructing, repairing
or caring for any park property or interfere with any improvements
being made within or about a city park or recreation area.
C. No person shall use threatening, abusive, boisterous,
insulting or indecent language or gesture within a city park or recreation
area, nor shall any oration, harangue, public demonstration or any
nuisance be made.
D. It shall be unlawful for any person to be in or upon
any portion of any park or recreation area between the hours of dusk
and dawn, prevailing local time, unless a written permit from the
Council has been issued to such person or persons on application made.

Any person violating this article shall, upon conviction, be
subject to a fine of not less than $100 nor more than $2,000; or imprisonment
in the county jail for a term not exceeding 90 days or by a period
of community service not exceeding 90 days. Any person who is convicted
of violating this article within one year of the date of a previous
violation of the same article and who was fined for the previous violation,
shall be sentenced by a court to an additional fine as a repeat offender.
The additional fine imposed by a court upon a person for a repeated
offense shall not be less than the minimum or exceed the maximum fine
fixed for a violation of the article, but shall be calculated separately
from the fine imposed for the violation of the article.
