To achieve the purposes of the Village of Kinderhook Code and to implement the Comprehensive Plan, the Village of Kinderhook hereby establishes the following seven districts and two overlay zones, with the following goals:
A. 
Base zoning districts.
(1) 
F-1 100-Year Flood Plain District: this district covers the 100-year floodplain. The purpose of this district is to preserve the natural function of a floodplain, to protect general health and welfare, prevent flood damage and preserve open space.
(2) 
A Agricultural District: the purpose of this district is to protect sensitive environmental lands, promote agricultural and compatible open space uses by discouraging large-scale residential development. A density of one dwelling unit per 120,000 square feet is established.

(3) 
AR Agricultural/Residential District: the purpose of this district is to preserve agriculture and open space. To do this, a district of a moderate-density residential development is established with mandatory conservation subdivisions of 20,000 square feet minimum lots consistent with traditional street, lot, setback and other patterns that simultaneously preserve open space, such as lands available for agriculture. An overall density of one dwelling unit per 120,000 square feet is hereby established.
(4) 
R-1 Residential: the purpose of this district is to allow lower-density residential development consistent with existing development patterns. A density of one dwelling unit per 40,000 square feet is hereby established.
(5) 
R Residential District: the purpose of this district is to promote residential development at higher densities consistent with the traditional and historical residential core of the Village. A density of one dwelling unit per 20,000 square feet is hereby established.
(6) 
B-1 Business District: the purpose of this district is to provide a focal point for commercial activities in the Village and to maintain traditional and historical patterns and styles that promote Village character, pedestrian atmosphere and economic development.
(7) 
B-2 Business District: the purpose of this district is to allow additional commercial uses that are more automobile-dependent or that need larger lot sizes than may be available in the B-1 District in a concentrated node within the Village.
B. 
Overlay zones.
(1) 
F-2 500-Year Flood Plain Overlay District: this overlay district covers the 500-year floodplain. The purpose of the district is to preserve the natural function of a floodplain, to protect general health and welfare and prevent flood damage.
(2) 
H Historic Preservation District: the purpose of this district is to preserve and maintain structures and areas having historic significance and to ensure that the distinctive historical and architectural character of this district shall not be negatively impacted by incompatible new construction, exterior alteration, restoration, reconstruction or demolition.
Where uncertainty exists with respect to the boundaries of any of the aforesaid districts shown on the Zoning Map, the following rules shall apply:
A. 
Where district boundaries are indicated as approximately following the center lines or right-of-way lines of streets, highways, public utility easements or watercourses, said boundaries shall be deemed to be automatically moved if a center line or right-of-way line of such street, highway, public utility easement or watercourse is moved a maximum distance of 50 feet.
B. 
Where district boundaries are indicated as approximately following the Village boundary line, property lines, lot lines, utility lines or projections thereof, said boundaries shall be coincident with such lines or projections thereof.
C. 
Where district boundaries are so indicated that they are approximately parallel to the Village boundary line, property lines, lot lines, right-of-way lines or projections thereof, said boundaries shall be construed as being parallel thereto and at such distances therefrom as indicated on the Zoning Map or as shall be determined by use of the scale shown on the Zoning Map.
D. 
Where a district boundary line divides a lot in single or joint ownership of record at the time such line is established, the regulations for the less restricted portion of such lot shall extend not more than 30 feet into the more restricted portion.
E. 
In all other cases, where not dimensioned, the location of boundaries shown on the map shall be determined by the use of the scale appearing thereon.
Except as hereinafter provided:
A. 
No land or building shall hereafter be used, occupied, erected, moved or altered unless in conformity with the regulations hereinafter specified for the district in which it is located.
B. 
No building shall hereafter be erected or altered to exceed the maximum height, to occupy a greater percentage of lot area or to accommodate or house a greater number of families than is required for the district in which such building is located.

C. 
No part of a yard or other open space required about any building shall be included as part of a yard or other open space similarly required for another building.
D. 
No off-street parking or loading space required for one building or use shall be included as meeting, in whole or part, the off-street parking or loading space required for another building or use, except as provided in § 130-17B.
E. 
No off-street parking or loading space shall be so reduced in area that it does not meet the requirements of this chapter.
