A certain document, one copy of which is on
file in the office of the Borough of Upland's Manager/Secretary, being
marked and designated as the "International Fuel Gas Code, 2003 Edition,"
and any and all subsequent editions, including any appendix chapters
as published by the International Code Council, be and is hereby adopted
as the Fuel Gas Code of the Borough of Upland, in the Commonwealth
of Pennsylvania, for regulating and governing fuel gas systems; and
regulations, provisions, penalties, conditions and terms of said Fuel
Gas Code on file in the office of the Borough of Upland are hereby
referred to, adopted and made a part hereof, as if fully set out in
this chapter, with the additions, insertions, deletions and changes,
if any as prescribed in § 141.2 of this chapter.
The following sections are hereby revised as
follows:
A. Section 101.1. Insert: "the Borough of Upland."
B. Section 106.5.2. Insert: "As set from time to time
by resolution of the Borough Council, and will be located in the office
of the Borough Manager/Secretary."
C. Section 106.5.3. Subsection 2: Insert: "100%"; Subsection
3: Insert: "50%."
D. Section 108.4. Insert: "summary offense," "$1,000
fine" "not more than 30 days."
E. Section 108.5. Insert: "not less than $300 nor more
than $1,000."
All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
If any section, subsection, sentence, clause
or phrase of this chapter is, for any reason, held to be unconstitutional,
such decision shall not affect the validity of the remaining portions
of this chapter. The Upland Borough Council hereby declares that it
would have passed this chapter, and each section, subsection, sentences,
clauses and phrases thereof, irrespective of the fact that any one
or more sections, subsections, sentences, clauses or phrases be declared
unconstitutional.
Nothing in this chapter or in the International
Fuel Gas Code hereby adopted shall be construed to affect any suit
or proceeding impending in any court, or any rights acquired or liability
incurred, or any cause or causes of action acquired or existing, under
any act or ordinances hereby repealed as cited in § 14-3
of this chapter; nor shall any just right or remedy of any character
he lost, impaired or affected by this chapter.
That the Borough Manager/Secretary shall certify
to the adoption of this chapter and cause the same to be published
as required by law; and this chapter shall take full force and effect
immediately upon the date and time of final passage and approval by
the Upland Borough Council.
