The designation of dwellings, dwelling units,
buildings and/or other structures as unfit for human habitation and
the procedure for the condemnation, placarding and demolition of such
unfit dwellings, dwelling units, buildings and/or other structures
shall be performed in compliance with the following:
A. Any dwellings, dwelling units, buildings and/or other
structures found to have any of the following defects shall be condemned
as unfit for human habitation or use and shall be so designated and
placarded by the Housing Officer:
(1) One which is so damaged, decayed, dilapidated, unsanitary,
unsafe or vermin-infested that it creates a serious hazard to the
health or safety of the occupants or of the public.
(2) One which lacks illumination, ventilation or sanitation
facilities adequate to protect the health or safety of the occupants
or of the public.
(3) One which because of its general condition or location
is insanitary or otherwise dangerous to the health or safety of the
occupants or to the public.
(4) One which has numerous and/or, in the discretion of
the Housing Officer, serious violations of other provisions of this
chapter.
B. Any dwelling, dwelling unit, building and/or other
structure condemned as unfit for human habitation or use and so designated
and placarded by the Housing Officer shall be vacated within a reasonable
time as ordered by the Housing Officer.
C. No dwelling, dwelling unit, building and/or other
structure which has been condemned and placarded as unfit for human
habitation or use shall again be used for human habitation or use
until written approval is secured from and such placard is removed
by the Housing Officer. The Housing Officer shall remove such placard
whenever the defect or defects upon which the condemnation and placarding
action were based have been eliminated.
D. No person shall deface or remove the placard from any dwelling, dwelling unit, building and/or other structure which has been condemned as unfit for human habitation or use and placarded as such except as provided in Subsection
C.
E. If the dwelling unfit for human habitation can reasonably
be repaired so that it will no longer exist in violation of the terms
of this chapter, it shall be ordered repaired by the Housing Officer.
