Wherever a space shall be marked off on any street for the parking of an individual vehicle, every vehicle there parked shall be parked within the lines bounding such space.
A. 
General rule. Except when necessary to avoid conflict with other traffic or to protect the safety of any person or vehicle or in compliance with law or the directions of a police officer or official traffic control device, no person shall:

(1) 
Stop, stand or park a vehicle:
(a) 
On the roadway side of any vehicle stopped or parked at the edge or curb of a street, or within the right-of-way of a roadway where it would have been possible for the operator of said vehicle to pull it into the curb or the edge of a street.
(b) 
On a sidewalk.
(c) 
Within an intersection.
(d) 
On a crosswalk.
(e) 
At any place where official signs prohibit stopping, standing or parking.
(2) 
Stand or park a vehicle:
(a) 
In front of a public or private driveway.
(b) 
Within 15 feet of a fire hydrant.
(c) 
Within 25 feet of an intersection.
(d) 
Within 20 feet of the driveway entrance to any fire station or, when properly sign-posted, on the side of a street opposite to the entrance of any fire station within 75 feet of the entrance.
(e) 
At any place where official signs prohibit standing or parking.
B. 
The parking, stopping or standing of vehicles in the locations described in Subsection C of this section is hereby restricted as follows:
(1) 
In locations designated as "no parking," the parking of vehicles is prohibited at all times or during the hours or time periods indicated, if any.
(2) 
In locations designated as "limited parking," the parking of vehicles is hereby prohibited for a longer period of time than that specified during the hours indicated, if any.
(3) 
In locations designated as "no standing," the standing of vehicles is hereby prohibited at all times or during the hours indicated, if any.
(4) 
In locations designated as "no stopping," the stopping of vehicles is hereby prohibited at all times or during the hours indicated, if any.
C. 
In accordance with the provisions of Subsection B, the parking, stopping, or standing of vehicles is restricted as indicated in the following locations:

The parking of commercial motor vehicles, tractors, house trailers and motorbuses, as those terms are defined by the Vehicle Code of the Commonwealth of Pennsylvania, is hereby prohibited on all Borough-owned streets within Marietta Borough on any day from 6:00 p.m. to 6:00 a.m. of the following day, except for the purpose of loading or unloading such vehicles in areas where off-street parking facilities are not available.

A. 
Definitions. As used in this section, the following terms shall have the meanings indicated:
MOTOR VEHICLE
As defined in the Vehicle Code of the Commonwealth of Pennsylvania as heretofore and hereafter amended.
VEHICLE
A land vehicle, trailer, semitrailer, tractor or other vehicle used or designed for the transportation of persons or property.
B. 
It shall be illegal to park a vehicle or motor vehicle on any street or alley in the Borough of Marietta for more than 48 consecutive hours.
C. 
It shall be illegal to make any repairs to any vehicle or motor vehicle while said vehicle or motor vehicle is parked on any street or alley in the Borough of Marietta, except that the following repairs or types of repairs may be made; provided, however, that in no event shall any repair be made in violation of Subsection B of this section:
(1) 
Emergency repairs which are necessary to prevent the obstruction of traffic.
(2) 
Emergency repairs to permit the removal of a vehicle or motor vehicle from the streets or alleys of the Borough of Marietta.
(3) 
Minor repairs, such as tire changes.

A. 
Any individual requesting an on-street handicapped parking space within the Borough of Marietta shall submit an application to the Public Safety Chairman, on the official Marietta Borough form. Any individuals who propose to maintain eligibility for existing handicapped parking spaces beyond August 31, 1986, shall likewise submit an application to the Public Safety Chairman.[1]

B. 
The Public Safety Chairman shall review all applications so submitted and make a recommendation to the Handicapped Parking Space Eligibility Review Board, which shall be composed of the Public Safety Committee. The Review Board shall approve or reject all such applications. Anyone aggrieved by the decision of the Review Board shall have a right of appeal to the Borough Council. The Public Safety Committee shall include in its monthly report, at the regular Borough Council meeting, information as to the handicapped parking space applications and permits and upon which any action was taken by the Review Board since the prior month's report to Borough Council. The Review Board shall review all handicapped parking spaces or areas, at least once annually, to determine whether or not the individuals who requested the handicapped parking spaces or areas continue to be eligible under the criteria hereinafter set forth.[2]

C. 
The criteria for the creation of a handicapped parking space shall be as follows:
(1) 
The individual so requesting the space shall exhibit proof that he/she has qualified for a handicapped person's license plate under the regulations issued by the Pennsylvania Department of Transportation.
(2) 
No more than one handicapped parking space shall be issued at the request of any one individual within the corporate limits of the Borough of Marietta.
(3) 
The location of said space shall be determined by the Review Board but shall be located as close as possible to the front exit of the dwelling in which the individual requesting the handicapped parking space resides.
(4) 
No more than one handicapped parking space shall be provided per dwelling unit within the corporate limits of the Borough of Marietta.
(5) 
No handicapped parking space shall be provided for the location so requested if the Review Board determines that there exists a reasonable, accessible and practical off-street parking space or an area which could be used for such off-street parking to serve such location.
(6) 
The individual requesting the handicapped parking space shall first demonstrate that the individual has a physical impairment, such as loss of use of a lower extremity or cardiopulmonary condition, which substantially restricts movements or otherwise requires the use of a wheelchair, crutches, walker or similar device for purposes of locomotion.
(7) 
No handicapped parking space shall be created unless it can be demonstrated that the physical condition giving rise to the request is reasonably expected to persist for a period of not less than six consecutive months.
(8) 
In considering an application for a handicapped parking space, a report or letter from the applicant's treating physician may be considered, but any such report shall not by itself be considered conclusive.
(9) 
In the event that there is material improvement in the physical condition of the applicant to the extent that the applicant would no longer qualify under the criteria set forth herein, the handicapped parking space shall be removed. Likewise, the handicapped parking space shall be removed if there is a change in the circumstances such that the handicapped parking space shall no longer be appropriate under the criteria referred to herein. The holder of a handicapped parking space shall have the affirmative duty to report to the Borough Secretary of the Borough of Marietta any material improvement in his or her physical condition as set forth in this subsection, or any other change in the circumstances which would call for the removal of the handicapped parking space as set forth in this subsection.
D. 
Applications fees.
(1) 
For all existing handicapped parking areas within the Borough of Marietta, no application fee need accompany the application for the continuance of the handicapped space. Unless otherwise applied for and approved as set forth above, all existing handicapped parking spaces shall terminate as of August 31, 1986.
(2) 
For all other applications for handicapped parking areas, there shall be submitted, along with the application, an application fee as established by resolution of the Borough Council. Should the application be approved, the applicant, as a condition to the creation of the handicapped parking space by the erection of appropriate signs and the like, shall deposit with the Borough the flat fee as established by resolution of the Borough Council to cover the cost of labor and materials necessary to establish such handicapped parking area. Should conditions require the Borough of Marietta to incur labor and material costs over and above the flat fee, then these additional costs shall be passed on to the applicant, the total of which shall not exceed an amount as established by resolution of the Borough Council.[3]

E. 
This section shall not limit the discretion of the Marietta Borough Council to establish handicapped parking areas at other locations where the Borough Council deems appropriate.

Borough Council, by resolution adopted from time to time, may establish parking permits and related permitting processes. As part of any such parking permit program, Borough Council may adopt rules and regulations for the program. The rules and regulations may include the imposition of a fee for obtaining such a permit, establishing who may obtain such permit, and establishing permit parking locations and parking hours.
