The terms and conditions of this chapter shall be enforced through the Planning Board and/or the Zoning Official of the Township.
A. 
Premature sale.
(1) 
Amount of penalty. If, before final subdivision approval has been granted, any person transfers or sells or agrees to sell, except pursuant to an agreement expressly conditioned on final subdivision, as owner or agent, any land which forms a part of a subdivision for which Township approval is required, such person shall be subject to one or more of the following: to a penalty of not less than $100 nor more than $1,000, imprisonment for a term not to exceed 90 days or a period of community service not to exceed 90 days. Each lot disposition and each day in violation shall be deemed a separate violation.

(2) 
Civil action. In addition to the foregoing, Chester Township may institute and maintain a civil action:
(a) 
For injunctive relief.
(b) 
To set aside and invalidate any conveyance made pursuant to such a contract of sale if a certificate of compliance has not been issued in accordance with the law by the Township.
(3) 
Effect on transferee, purchaser or grantee. In any such action, the transferee, purchaser or grantee is entitled to a lien upon the portion of the land from which the subdivision was made that remains in the possession of the developer, his or her assigns or successors, to secure the return of any deposits made or purchase price paid and also a reasonable search fee, survey expense and title closing expense, if any. Any such action must be brought within two years after the date of the recording of the instrument of transfer, sale or conveyance of such land, or within six years, if unrecorded.
B. 
Other offenses.
(1) 
Amount of penalty. Any person, firm or corporation violating any of the provisions of this chapter shall, upon conviction, be punished by one or more of the following: a fine of not less than $100 nor more than $1,000, imprisonment for not more than 90 days or a period of community service not to exceed 90 days, for each offense. Each lot disposition and each day that a violation occurs or is committed will constitute a separate offense.

C. 
Stop-work orders and revocations. In the event of failure to comply with requirements of this chapter or with the requirements of plan approval, the Township Engineer may issue stop-work orders and the Construction Official may refuse to issue building permits and/or certificates of occupancy, and may revoke building permits which have been issued.
