A certain document, three copies of which are on file in the office of the Borough Secretary of the Borough of Edgeworth, being marked and designated as the "BOCA National Fire Prevention Code, Tenth Edition, 1996," as published by the Building Officials and Code Administrators International, Inc., be and hereby is adopted as the Fire Prevention Code of the Borough of Edgeworth; for the control of buildings, structures and premises as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said BOCA National Fire Prevention Code are hereby referred to, adopted and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes prescribed in §
65-2 of this chapter.
The following sections of the above-referenced
code are hereby revised as follows:
A. In Section F-101.1, insert "Borough of Edgeworth."
B. In Section F-105.1, insert at the end "The Building
Inspector shall be the code official responsible for enforcement of
this code."
C. In Section F-105.2, delete the remainder of the paragraph
after "jurisdiction."
D. In Section F-107.2, delete F-107.2 and replace it
with the following:

Section F-107.2 Permits required: Permits shall be obtained from the Code Official prior to the commencement
of any activity listed in F-107.2.3. Permit fees not set forth herein
will be established by resolution of the Council of the Borough of
Edgeworth, which fees may be adopted and changed from time to time.
Issued permits shall be kept on the premises designated therein at
all times and shall be readily available for inspection by the Code
Official.

E. Retain Section F-107.2.1.
F. In Section F-107.2.2, change "six months" to "90 days."
G. Table F-107.2.3 is adopted as completed.
H. In Section F-107.7.1, delete the entire section and
add:

Section F-107.7.1. Suspension of permit: Any permit issued shall become invalid if the authorized work is
not commenced within six months after issuance of the permit or if
the authorized work is suspended or abandoned for a period of six
months after the time of commencing the work or if the authorized
work has not been completed within one year after the date the permit
is issued.

I. Delete Section F-112.3 and replace it with the following:

Section F-112.3. Penalty for violations. Any person who shall violate any of the provisions hereof or fail
to comply with any order issued hereunder shall be guilty of a summary
offense and, upon conviction thereof, shall pay a fine of up to $1,000
for the violation. Each day that a violation occurs or continues shall
be a separate offense. The notice of violation provisions hereunder
are not mandatory and are not conditions which must be met prior to
commencement of appropriate proceedings to enforce the provisions
hereof or to seek penalties hereunder.

J. Sections F-113.0, F-113.1, F-113.2, F-113.2.1, F-113.2.2,
F-113.2.3, F-113.2.4, F-113.2.5, F-113.2.6, F-113.3, F-113.4, F-113.4.1,
F-113.5, F-113.6, F-113.6.1, F-113.6.2 and F-113.7 are deleted and
the following is inserted:

Section F-113.1 Appeal: The owner
of a building or structure or any other party in interest may appeal
from a decision of the Code Official to the Council of the Borough
of Edgeworth, provided that no such appeal shall be allowed unless
taken within 30 days from the date of such decision. Application for
appeal may be made in writing when it is claimed that the true intent
of this chapter or the rules legally adopted thereunder have been
incorrectly interpreted, the provisions of this chapter do not fully
apply or special hardship exists, in which cases the Council may waive
or modify the provisions of this chapter as long as it is in the public
interest to do so.

The limits referred to in Section F-3003.2 of
the BOCA National Fire Prevention Code/1996 in which the storage of
explosive materials is prohibited are hereby established as follows:
within 500 feet of a residence or occupied structure.
Chapter 9 of the 1996 BOCA Building Code dealing
with Fire Protection Systems, is incorporated herein by reference
and adopted. The requirements in the Borough's current building code
relating to the same subject matter are not repealed hereby; it being
the intent hereof to have the more restrictive terms apply.
Any person whose application has been refused
may appeal to the Council from the decision of the Code Official,
provided that no appeal shall be allowed unless taken within 30 days
from the date of refusal. The Council may, when hardship is shown,
modify provisions of this chapter, provided that it is in the public
interest to do so.
