The Borough Council recognizes that the use
of skateboards, roller skates, street skates, scooters, pedalcycles
and any other humanpowered device or devices has become prevalent
in the borough. The use of these devices on public areas and streets
my constitute a danger to the public and the person using these devices.
In order to lessen the hazards to the public health, safety and welfare,
the Borough Council has determined to regulate the use of skateboards,
roller skates, street skates, scooters, pedalcycles or any other type
of device or devices that are propelled solely by human power in the
borough.
The parent and/or guardian of any child shall
not authorize or knowingly permit any such child to violate any provision
of this chapter.
Any person who shall violate any of the provisions
of this chapter shall be subject to the following penalties:
A. First offense: The violator and/or his parent or guardian
shall receive a written warning. Such written warning will be kept
on file by the Borough Police Department for a period of one year.
B. Second offense: the impoundment of the violator's
skateboard, roller skates, street skates, scooter, pedalcycle or other
device for a period not to exceed 15 days and/or a sentence of a fine
of between $5 and a maximum fine of $25, plus costs of prosecution,
with payment paid in full prior to return of the mentioned device.
C. Third and subsequent offenses: the impoundment of
the violator's skateboard, roller skates, street skates, scooter,
pedalcycle or other device for a period not to exceed 30 days and/or
a sentence of a fine of between $25 and a maximum fine of $50, plus
costs of prosecution, with payment paid in full prior to return of
the mentioned device.
It shall be the duty of the Lititz Borough Police
Department to enforce the provisions of this chapter.
