There is hereby established and created as an
executive and enforcement function of the municipal government of
the Township of Elk, a police force, which shall constitute a department
of the Township of Elk and shall be known as "the Elk Township Police
Department."

A. The Police
Department shall consist of the following positions:

(3) One
- Detective Sergeant.
B. In the event
that the position of Chief of Police is vacated as a result of death,
illness, incapacity or any other reason, the Lieutenant shall temporarily
assume the position of Acting Chief of Police. In the event there
is more than one Lieutenant, the Chief shall be designated by Township
Committee.
C. The Chief
of Police shall be the executive and supervisory officer of the Police
Department and is responsible to the Township Committee of the Township
of Elk.
D. Officers
of the Department shall rank in the order set forth above, the rank
seniority shall be determined by date of advancement to that rank.
E. The senior
ranking officer on duty on any shift shall be in charge of the Department
during the shift unless relieved by an officer of higher rank, who
shall thereupon sign an entry in the blotter to that effect.

Pursuant to N.J.S.A. 40A:14-118, the Township
Committee of the Township of Elk is hereby designated as the appropriate
authority for the maintenance, regulation and control of the Police
Department and which shall be authorized to adopt and promulgate by
ordinance rules and regulations and shall establish and enforce standard
operating procedures for the government of the Police Department and
for the discipline of its members and which shall constitute the hearing
tribunal under the above-referenced statute. The line of authority
relating to the police function in the Township of Elk shall consist
of an unbroken line extending from the Township Committee through
the Public Safety Director and Public Safety Committee (with such
powers as shall be delegated to said Public Safety Director and Public
Safety Committee by the ordinances and resolutions of the Township
Committee or otherwise delegated by the Township Committee), through
the Chief of Police down to the level of execution and vice versa.
The Chief of Police shall be the head of the Police Department and
shall be directly responsible to the Township Committee as the appropriate
authority, for the efficiency and routine day-to-day operations thereof,
and the said Chief of Police shall perform the duties prescribed by
N.J.S.A. 40A:14-118 and otherwise authorized by state law or by policies
established by the Township Committee.
