The Borough of Glen Gardner, not having a paid
or par-paid Fire Department, hereby recognizes and contracts with
the Glen Gardner Fire Company Number 1, a volunteer fire company,
for the purpose of extinguishing fires as permitted pursuant to N.J.S.A.
40A: 14-68.
The Chief of the Fire Department and all executive
officers of the Department shall be elected and shall serve terms
of office pursuant to the procedures and terms established in the
Constitution and bylaws of the Fire Department, as the same may be
revised from time to time. The Borough Council shall appoint the Fire
Chief selected by the Department as the Fire Chief of the Borough
for a term of office coextensive with that as elected by the Department.
The membership of the Fire Department shall
be determined at the sound discretion of the members in good standing
of the Department in accordance with its Constitution and bylaws,
as the same may be revised from time to time, and in accordance with
all applicable laws, rules and regulations. The Fire Department shall
establish classes of membership and rules and regulations with respect
thereto, including, but not limited to, active, social, honorary,
rescue, junior, life, cadet and fire police, in accordance with its
Constitution and bylaws, as the same may be revised from time to time.
Exemption certificates shall be issued to members
of the Fire Department who shall have served and complied with the
requirements of N.J.S.A. 40A:14-56, as the same may be amended from
time to time.
The Fire Department shall be entrusted with
the care and custody of any firefighting equipment now owned by the
Borough of Glen Gardner, and with such apparatus and equipment as
may be hereafter acquired; subject, however, at all times to the control
of the Borough Council.
The Chief of the Fire Department shall prepare
and file with the Borough Clerk, annually in January of each year,
a statement, under oath, setting forth the name, residence, age and
citizenship of every member of the Fire Department, and the date of
his or her admission to membership, together with the percentage of
fire duty credited to each member of the Department for the preceding
year. Said statements shall constitute official records of the Fire
Department, from which the Borough Council shall determine when certificates
of exemption shall be issued to the members of the Department.
The Secretary of the Fire Department shall,
on October 1 of each year, file with the Assessor of the Borough of
Glen Gardner a list, under oath, of the active members of the Fire
Department of the Borough and the persons who have been granted exemption
certificates after having served in said Fire Department.
The Chief of the Fire Department shall have
complete charge of the Fire Department at all fires and drills, and
he or she shall be charged with the duty of enforcing regulations
of the Borough Council respecting the use, care and maintenance of
any firefighting equipment owned by the Borough. He or she shall,
form time to time, make recommendations to the Borough Council for
necessary appropriations, supplies and repairs, and such other recommendations
as he or she deems to be for the betterment of the Department. He
or she shall be required to report, at any time when requested by
the Borough Council, on the condition of the equipment owned by the
Borough and the condition, activity and discipline of the Department.
