The Light and Power Department will use reasonable
diligence to provide a continuous, regular and uninterrupted supply
of service, but should the supply be interrupted by the Light and
Power Department for the purpose of making repairs, changes or improvements
in any part of its system for the general good of the service or for
the safety of the public or should the supply or service be interrupted
or fail by reason of accident, strike, legal process, state interference
or any other cause whatever, the Borough shall not be liable for damages,
direct or consequential, resulting from such interruption or failure.
The Light and Power Department's service connections,
transformers, meters and appliances have a definite limited capacity,
and the customer shall notify the Light and Power Department, in writing,
of any additions to the customer's connected load so that adequate
facilities may be provided. The customer will complete a load data
sheet and present the same to the Department prior to purchasing or
installing additional loads. The customer will be held responsible
for any damage resulting from a violation of this rule.
Where demands are reassessed or power recomputed
or customers found to be on an improper rate as the result of an investigation
made at the customer's request or as a result of a Department inspection,
the change of billing to the new demand or power factor or to the
proper rate may be applied, within its net-payment period to the bill
for the regular meter reading preceding such investigation and will,
in any event, apply to the bill for the month during which the check
is made.
No officer, agent or employee of the Light and
Power Department shall demand or accept any compensation or reward
from any customer or other person for services rendered in connection
with the electric system; it being the intent of this section that
all officers, agents and employees of the Light and Power Department
shall be compensated for such services solely by the salaries and/or
wages paid therefor by the Borough.
No person shall willfully and intentionally
interfere with or molest in any way wires or equipment of the Borough
of Lehighton over or by which the Borough furnishes or intends to
furnish electric current to any of its customers or to the streetlights
operated by it.
All customers using electrical energy shall
maintain their equipment in such manner and shall provide such auxiliary
devices as may be necessary so to prevent any adverse impact upon
the Borough's electrical distribution system, interference with radio
or other communication signals and undue fluctuation of load resulting
in flickering lights or other disturbances. The Light and Power Department
may refuse to serve or to continue to serve premises wherein the requirements
of this section are not carried out.
