No person shall occupy or use any building or
portion thereof for residential purposes after such building or portion
thereof has been vacated due to the sale of such residential property
or for which there has been a change in use or a change in occupancy
or tenancy until the current owner of such premises has applied for
and secured a certificate of smoke detector and carbon monoxide alarm
compliance ("CSDCMAC") from the enforcement authority of the Borough
of Northvale.
Notwithstanding the provisions of §
80-6 above, nothing shall prevent the Fire Official from making a finding of imminent hazard pursuant to N.J.A.C. 5:18-2.14 or the Construction Official from making a finding of unsafe building pursuant to N.J.A.C. 5:23-2.23 and requiring correction of such hazard or unsafe condition in accordance with those regulations.
The owner or landlord and/or their respective
agents shall be responsible for notifying the enforcement authority
of any pending new tenancy, ownership or change of use 21 days prior
to said changes.
This article shall be enforced by any appointed
member of the Northvale Fire Prevention Bureau.
Notice shall be included on all tax searches
and added assessment searches by the Tax Collector of the Borough
of Northvale stating that a certificate of smoke detector and carbon
monoxide alarm compliance is required for a change of occupancy, sale
or vacation of any residential premises. Failure to affix such notice
shall not constitute a defense for failure to obtain said certificate.
Penalties pertaining to requirements hereunder
shall be in accordance with the Uniform Fire Code, N.J.A.C. 5:18 et
seq.
