This chapter shall be known as the "Administrative
Code of the Municipality of Kingston, Pennsylvania."
As used in this chapter, the following words,
terms and phrases shall mean or include the following:
ADMINISTRATIVE
The function of carrying out the policies, ordinances or
mandates by the Mayor.
ADMINISTRATOR
The duly appointed Administrator of the Municipality of Kingston,
as provided for in the Home Rule Charter.
ADVISORY
The function of gathering facts and making recommendations
to the Mayor, the Administrator or the Council.
BOARD
A body established under the supervision of the law or by
a valid ordinance of the municipality, on a permanent basis and for
indefinite duration, to perform those functions of a judicial or quasi-judicial
nature that are specified in the ordinance creating the board or the
law governing it, and to be composed of three (3) or more individuals,
appointed by the Mayor with the approval of Council; provided that
where a body falling within this definition of "board" shall, by law,
be required to be designated as a "commission," that fact shall be
clearly stated in the ordinance creating or governing that commission,
and that ordinance shall specify that that commission shall perform
the functions of a "board" rather than a commission.
CODE
This chapter (the Administrative Code of the Municipality
of Kingston).
COMMISSION
A body established under the provisions of the law or by
a valid ordinance of the municipality, on a permanent basis and for
indefinite duration, to perform those functions of an advisory or
administrative nature that are specified in the ordinance creating
the commission or in the law governing it, and to be composed of three
or more individuals, appointed by the Mayor with the approval of Council;
provided that where a body falling within this definition of "commission"
shall, by law, be required to be designated as a "board," that fact
shall be clearly stated in the ordinance creating or governing that
board, and that ordinance shall specify that that board shall have
only the authority of a "commission," as defined in this section.
COMMITTEE
A body serving for a designated period of time on an ad hoc
and purely advisory basis, comprising three or more individuals appointed
by the Mayor.
COUNCIL
The duly elected Council of the Municipality of Kingston,
as provided for by the Home Rule Charter.
EMPLOYEE
Any full-time employee of the Municipality who has been hired
in accordance with the provisions of the merit system. Part-time employees
and those hired through a state/federal program shall not be considered
full-time employees.
HOME RULE CHARTER
The Home Rule Charter of the Borough of Kingston, which was
adopted November 5, 1974, with, if any, legally enacted amendments.
MAYOR
The duly elected Mayor of the Municipality of Kingston, as
defined in the Home Rule Charter.
MUNICIPALITY
The Municipality of Kingston, which formerly was known as
the "Borough of Kingston, Pennsylvania."
STATE LAW
The Constitution of Pennsylvania and any applicable statutes
of the commonwealth.
