The owner or tenant of lands lying within the limits of said Township shall keep all brush, hedges and other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, cut to a height of not more than 2 1/2 feet where it shall be deemed necessary and expedient for the preservation of public safety.

The owner or tenant of lands with brush, hedges and other plant life which endangers public safety, as outlined hereinabove, shall be notified by the Township by certified mail or registered mail of the public safety problem which the Township wishes to have remedied. The owner or tenant of such lands shall then have 10 days to provide for the cutting of the same by or under the direction of the Public Works Supervisor of the said Township of Commercial.

In all cases where brush, hedges and other plant life are cut from any land within the limitations of the above sections by or under the direction of the Public Works Supervisor, such officer shall certify the cost thereof to the Township Committee, which shall examine the certificate, and if found correct, shall cause the cost as shown thereon to be charged against said lands, or in the event that such cost is excessive, to cause the reasonable cost thereof to be charged against said lands. The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands the same to bear interest at the same rate as other taxes and shall be collected and enforced by the same officers and in the same manner as taxes.

The Township's Public Works Supervisor shall have the primary responsibility for the enforcement of this article.

Any person violating any portion of this article shall be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof.
