The purpose of this bylaw is to protect the welfare and safety of those persons using Waushakum Pond.
(A) 
All motor boats must (except when prevented by a narrow channel or other boats or passing under bridges or rounding sharp bends) keep one hundred and fifty (150) feet distance from anchored or moored boats, piers, rafts, floats, a line of floats outlining swimming areas, skin divers' flags, or the shore line. In all such cases, the speed of such motor boats shall be reduced to headway speed, so as to provide full visibility and control, and prevent the boat's wash from being thrown into, or causing excessive rocking to other boats, barges, aquaplanes, and other devices being towed by power. The operator of the towing boat shall be responsible for compliance therewith.
(B) 
The use of powered craft generally described as a "JET SKI," "SURF JET," "WET BIKE," or otherwise described as a "PERSONAL WATERCRAFT" is prohibited except when used by law enforcement personnel in the course of their duties.
PERSONAL WATERCRAFT
means a small vessel which uses an inboard motor powering a water jet pump as its primary source of motive power and which is designed to be operated by persons sitting, standing, or kneeling on the vessel. The term includes, but is not limited to a jet ski, wet bike, or surf jet, so called.
(A) 
Criminal disposition. Any violation of this chapter shall be punished by a fine of not more than one hundred dollars ($100.00) for each offense.
(B) 
Non-criminal disposition. Violations of any part of this chapter may be processed pursuant to Chapter 40, section 21D of the general laws of the commonwealth. Fines for violations shall be assessed as follows:
First offense: fifty dollars ($50.00)
Second and subsequent offenses: one hundred dollars ($100.00).
Any person having police powers shall have authority to issue notices of violations under this paragraph.
